A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF N~AHEIM GRANTING VARI&~CE NO. 2544.
WHEREAS, after a request for variance by Guy F.
and Ada Arnett, owners, was received, a public hearing
before the Planning Commission of the City of Anaheim was
held upon due and proper notice as a result of which Variance
No. 2544 was granted, covering the following described
property:
The North rectangular 2 acres of the following:
The North half of the Southwest quarter of the North-
west quarter of the Southwest quarter of section 14,
in Township 4 South, Range 11 West, San Bernardino
Base and Meridian, more particularly described as
follows:
Beginning at a point in the Westerly line of said
Section 14, South 00 15' 4511 East 674.42 feet from
the West quarter corner of said Section; thence North
890 36' 50" East 662.84 feet to a point; thence South
00 16' East 337.18 feet to a point; thence South 890
36' 40" West 662.87 feet to a point in the Westerly
line of said Section; thence North 00 15' 4511 West
337.21 feet to the place of beginning.
Reserving portion on the West included in road.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as a
result thereof the City Council does hereby make the following
findings:

1. That there are special circumstances applicable to
the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim, that a conditional zoning variance be,
and the same is hereby granted permitting a 54-unit apartment
complex on the aforedescribed property with a waiver of the
following section of the Anaheim M~~icipal Code:
SECTION 18.28.050(7) (a) - Minimum distance between build-
ings (29 feet required, 12 feet
proposed)

That said variance be granted subject to the following conditions:
1. That this Variance is granted subject to the
completion of Reclassification No. 73-74-12, now pending.

2. That subject property shall be developed
substantially in accordance with plans and specifications on
file with the City of Anaheim marked Exhibit No.1, Revision
No.1, Exhibit Nos. 2 and 3 provided, however, that sufficient
access shall be provided to the rear patio areas and that
adequate escape routes shall be provided for all units in case
of a fire, as stipulated to by the petitioners.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good cause
or failure of said owners, their heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and
the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of September, 1973.
