1973-414 RESOLUTION NO. 73R- 414 ,- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON CERTl\IN REAL PROPERTY AND FIXING A DATE FOR HEARING THEREON. WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1971 in connection with a request for vacation and abandonment of a portion of dedicated roadway commonly known as Mystic Lane, located east of Gilbert Street and north of Ball Road, in the City of Anaheim, to permit expansion of existing hospital facilities, more fully hereinafter described, subject to the following conditions: 1. That the annexation proceedings presently being pro- cessed be completed prior to completion of abandonment of said roadway. 2. That the application for rezoning under Reclassifica- tion No. 73-74-4 be approved, and all conditions of same be complied with. 3. That the applicant will bear all costs of removal, re- location and/or necessary revisions to existing water lines, sanitary sewer lines, gas lines and public utility facilities. 4. That the Southern California Gas Company maintain gas piping facilities within the area to be abandoned and a public utility easement be reserved for said Company and excepted from said abandonment. S. That a 10-foot sanitary sewer easement be reserved for the Garden Grove Sanitary District to accommodate existing facilities. 6. That the proposed new cul-de-sac be dedicated prior to the abandonment of existing street and the applicant be required to submit standard street improvement plans to the City Engineer for approval of said cul-de-sac. 7. That a bond be posted to cover the installation of new street improvements required at the cul-de-sac proposed, and for the relocation, remodeling and/or revision of existing utilities including sanitary sewer line. .- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it hereby declares its intention to vacate, abandon and close to public use that certain portion of dedicated roadway commonly known as Mystic Lane, located east of Gilbert Street and north of Ball Road, in the City of Anaheim, as it may relate to the following described property: That portion of dedicated roadway commonly known as Mystic Lane located in the City of Anaheim, County of Orange, State of California, lying within Tract No. 2563, as shown on a map recorded in Book 78, pages 18 and 19, Miscellaneous Maps, records of said Orange County, to be abandoned, described as follows: - Beginning at a point in the south line of Mystic Lane, said point being the northeast corner of Lot 54, all as shown on the map of said Tract No. 2563; thence N 890 22' 14" W, 159.43 feet along said southerly line to the beginning of a tangent curve concave southeasterly and having a radius of 45.00 feet; thence Southwesterly along said curve through a central angle of 360 56' 33" an arc distance of 30.59 feet to the beginning of a reverse curve concave easterly and having a radius of 45.00 feet; thence Southwesterly, Westerly, Northwesterly, Northeasterly and Easterly along said reverse curve through a central angle of 4570 53' 0611 an arc distance of 202.55 feet to th.e beginning of a reverse curve concave northeasterly and having a radius of 45.00 feet; thence Southeasterly and Easterly along the last men- tioned reverse curve through a central angle of 360 56' 3311 an arc distance of 30.59 feet to an intersection with the north line of said Mystic Lane, said north line being a line parallel with and 25 feet northerly of the centerline of said Mystic Lane; thence S 890 22' 14" E, 204.43 feet along said parallel line to a point in a line tangent to the be- ginning of a curve concave easterly and having a radius of 45.00 feet; thence Southwesterly and Southerly along the arc of the last mentioned curve through a central angle of 960 24' 00" an arc distance of 75.71 feet to the point of beginning. Reserving therefrom unto the Garden Grove Sanitation Dis- trict a sanitary sewer easement 10 feet wide over, under and across a strip of land lying 5 feet on each side of the centerline of Mystic Lane, as shown on the map of said Tract 2563. Also reserving therefrom unto the Southern California Gas Co. a public utility easement over, under ~~d across all of the above described area of Mystic Lane to be ,abandoned. and it elects to proceed under the provisions of the Street Vacation Act of 1971, subject to the reservations hereinabove stated. BE IT FURTHER RESOLVED that a time and place for hearing all persons interested in or objecting to the proposed vacation and abandonment has been fixed on the 9th day of Octobp-r , 1973, at 1:30 o'clock P.M. in the Council Chamber in the City Hall in the City of Anaheim. AND BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and Shall cause the same to be published in a manner prescribed by law, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City of Anaheim.
