1973-405 RESOLUTION NO. 73R-405 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF All~BEIM GRANTING VARIANCE NO. 2534. WHEREAS, after a request for variance by Dale E. and Sarah A. Fowler, owners, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2534 was granted, covering the following described property: The southerly 315.00 feet of that portion of Lot 2, Block ilK" of the Kraemer Tract in the City of Anaheim, County of Orange, state of California, as per map recorded in Book 12 pages 87 and 88 of Miscellaneous Records, in the Office of the County Recorder of Los Angeles County, California, described as follows: Beginning at a point distant westerly 628.65 feet, meas- ured at right angles from a point on the easterly line of said Lot 2 that is southerly 1155.00 feet from the north- easterly corner of said lot; thence southerly 693.00 feet parallel to the said easterly line; thence westerly 691.35 feet parallel with the northerly line of said lot to a point in the westerly line of said lot; thence northerly 693.00 feet along said westerly line; thence easterly 691.35 feet, parallel with the northerly line of said lot to the point of beginning. Except the easterly 11.35 feet thereof as described in a Deed to Dominic Jambon and Yvonne Jambon recorded June 21, 1961 in Book 5760 page 590 of Official Records. vrrlEREAS, thereafter, within the time prescribed by law an interested party or the City council on its own motion caused the review of said Planning Commission actx0n at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: -" 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code de- prives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby granted, permitting an industrial building on the aforedescribed property with a waiver of the following section of the Anaheim Municipal Code~ -1- ..,- ^'_.........."''-'>=,.~-~......,._...'---~-"~,.'''->,;,,~,,.,'"'''."..,'... - SECTION 18.52.060 - Masonry wall adjacent to Residential Zone (six-foot hiah wall required; none proposed) : That said variance be granted subject to the following conditions; 1. That the sidewalks shall be installed alonq Miller street as required by the City Engineer and in accordance-with standard plans and specifications on file in the office of the City Engineer. 2. That street lighting facilities along Miller Street shall be installed as required by the Director of Public utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilitiesj and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 5. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adja- cent properties. 6. That subject property shall be served by under- ground utilities. 7. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with six-inch high concrete curbs, and concrete wheel stops shall be provided for parking spaces. 8. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 9. That appropriate water assessment fees as deter- mined by the Director of Public utilities shall be paid to the City of ~~aheim prior to the issuance of a building permit. 10. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No.1, provided however, that a six-foot high chain link fence shall be constructed along the north, west, and south boundaries, and behind the required 50-foot setback along Miller Street. /~ 11. That Conditions Nos. 1, 2, 3, 5, 6, 7, 8, and 9, above mentioned, shall be complied with prior to final building and zoning inspections. -2- .- BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless other~ise speci- fied herein.
