A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RESOLUTION NO. 74R -53, PERSONNEL RULE 6, PREMIUM
PAY, SECTION 6.0, RELATING TO EXTENDING OVERTIME COMPEN-
SATION PROVISIONS TO TEMPORARY, SEASONAL, AND PART -TIME
EMPLOYEES
WHEREAS, the coverage of the Fair Labor Standards Act of 1938,
as amended, is being extended to municipal employers effective May 1,
1974, and
WHEREAS, the Personnel Director has recommended in a staff report
dated April 25, 1974 that overtime compensation provisions be extended to
temporary, seasonal and part -time employees to comply with overtime sections
of the Act, and
WHEREAS, the need exists to amend resolution 74R -53, Rule 6,
Section 6.0, which established overtime provisions for City employees,
and
WHEREAS, the City Council of the City of Anaheim does find that
the adoption of the recommended overtime compensation provision is in the
best interests of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim that Resolution No. 74R -53, Rule 6, Section 6.0 be and the same
is hereby amended to read as follows:
"RULE 6. PREMIUM PAY
Section 6.0 An employee in the classified service who performs
authorized work in excess of his regular work week, work day, or
shift shall be compensated for such overtime work at the rate of
one and one -half times his regular rate of pay. A temporary,
seasonal, or part -time employee in the exempt service who performs
authorized work in excess of forty (40) hours in his regular work
week shall be compensated for such overtime work at the rate of
one and one -half times his regular hourly rate of pay."
BE IT FURTHER RESOLVED that except to the extent amended,
Resolution 74R -53 shall remain in full force and effect, and
BE IT FURTHER RESOLVED that the effective date of this
resolution shall be May 1, 1974.
