A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DETERMINING THAT CERTAIN
PROPERTY SHOULD BE LEVIED FOR STREET
IMPROVEMENTS AND THE AMOUNT OF THE ASSESS-
MENT THEREFOR.
WHEREAS, the Improvement Act of 1911 (Chapter 27,
Section 5870 et seq.) authorized the installation of certain
street improvements by a municipal corporation; and
WHEREAS, the Improvement Act of 1911 further enables
the legislative body to assess the cost of said improvements
against the property abetting said street improvements; and
follows:
WHEREAS, a certain parcel of property described as

of the southerly 75 feet of the Northerly half
of the Southerly half of lot 15, Block K of the
Kraemer Tract, as per map recorded in Book 12,
pages 87 and 88 miscellaneous records of Los
Angeles, California.
was located on a block wherein street improvements had been
installed along 90% of the street frontage; and
WHEREAS, the Superintendent of Streets did notify
the owner of the owner's duty to install such improvements
within 60 days; and
WHEREAS, the property owner of the hereinbefore
described property failed to install such improvements within
60 days; and
WHEREAS, the City Council of the City of Anaheim
did give notice of a Pre Construction Hearing to the property
owner; and
WHEREAS, the City Council of the City of Anaheim
did hold a Pre Construction Hearing on August 14, 1973 at
which the property owner did appear to present his protest
or objection to the installation of said improvement by the
City of Anaheim; and
WHEREAS, the City Council did, by unanimous vote
order the installation of said improvements and overrule the
objections thereto; and
WHEREAS, the City of Anaheim did install said street
improvements at its expense and the City Council did give
notice to the property owner of a Post Construction Hearing;
and
WHEREAS, the City Council did hold a Post Construction
Hearing on April 30, 1974, to consider objections and protests
to the assessment of the costs of said improvements against
the hereinbefore described property; and

WHEREAS, the property owner did appear at said
Post Construction Hearing; and
WHEREAS, the Superintendent of Streets did submit
a report specifying the work which had been done, the cost
of construction, the description of the real property affected,
and the assessment of each parcel of land proposed to be
levied; and
WHEREAS, the City Council of the City of Anaheim
did consider said report and objections thereto; and
WHEREAS, said report did indicate that the City of
Anaheim did expend $5,834,28 in the cost of construction of
said improvements, engineering and acquisition of right of
way therefor; and
WHEREAS, the City Council did determine that the cost
of land acquisition and engineering design should not be levied
upon the property hereinbefore described.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim does determine that the property herein
before described should be assessed $2,870.72 as the cost of
cost of said improvements,
BE IT FURTHER RESOLVED that, should the property
owner fail to pay said assessment within five (5) days said
assessment is to be levied against the property,
BE IT FURTHER RESOLVED that the City Attorney be,
and he is hereby authorized to forward a certified copy of this
Resolution to the County of Orange for inclusion upon the
tax assessment against the hereinbefore described property.
THE FOREGOING RESOLUTION is approved and sicn by
