1974-155RESOLUTION NO. 74R- 155 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF CERTAIN REAL PROPERTY DESCRIBED HEREIN AND RESERVING THEREFROM CERTAIN EASEMENTS FOR PUBLIC UTILITY PURPOSES. WHEREAS, the City Council of the City of Anaheim did on the 19th day of March, 1974, declare by Resolution No. 74R -123 its intention to vacate and abandon a portion of the dedicated roadway known as Old Santa Ana Canyon Road west of Imperial Highway in the City of Anaheim, more fully herein- after described, subject to the following conditions: 1. That a public utility easement be reserved over, under and across and along the northerly 20 feet of the subject parcel to accommodate existing Anaheim electrical facilities. 2. That an easement for sanitary sewer line be reserved over, under and across the westerly 20 feet of Lot 8 and the northerly prolongation thereof in Tract 936 as shown on a map thereof recorded in Book 30, pages 1 and 2, Miscellaneous Maps, records of Orange County, California, together with all right of ingress and egress. 3. That an easement be reserved for the. Pacific Tele- phone Company over, under, along and across the northerly 10 feet to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground telephone, telegraph and communication structure as the Company may from time to time require consisting of poles, anchors, wires, cables, conduits, manholes, marker and neces- sary fixtures and appurtenances. 4. That an easement be reserved for the Southern California Gas Company over, under and across the northerly 10 feet to accommodate existing Gas Com- pany facilities. 5. That should applicant desire to utilize any of the area owned in fee by the City of Anaheim, that arrangements be made to purchase same, and /or an encroachment permit be applied for. 6. That applicant provide a modified proposed easterly terminus of Old Road at no cost to the City. and did set the 9th day of April, 1974, for thereon; and cul -de -sac at the Santa Ana Canyon a public hearing WHEREAS, the City Council finds from the evidence sub- mitted at said public hearing that that portion of the real property described herein and in said Resolution of Intention is unnecessary for present or prospective roadway and alley purposes but that certain public utility easements should be reserved therein. 73 -7A NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds that said public hearing was properly held and that all notices were given and publications made as required by law. 2. That that portion of the real property toward which a request for vacation and abandonment was directed is not necessary for present or prospective roadway and alley purposes and does hereby order that said portion, as herein set forth, be and it is hereby vacated, abandoned and closed to public use, subject to the conditions hereinabove set forth. 3. That said portion of real property herein ordered vacated, abandoned and closed to public use is situa- ted in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows, to wit: That portion of dedicated roadway located in the City of Anaheim, County of Orange, State of California, being that portion of Santa. Ana Canyon Road, 60.00 feet wide, as described in the deed recorded June 5, 1928 in Book 171, page 144, Official Records, to be vacated, lying southerly of the Santa Ana Valley Irrigation Com- pany Canal, as described in the deed recorded July 18, 1934 in Book 685, page 255, Official Records, to be abandoned, described as follows: Beginning at the southeast corner of Lot 45 in Tract 6717, as shown on a map recorded in Book 280, pages 44, 45 and 46, Miscellaneous Maps, records of said Orange County, said point of beginning being a point at the beginning of a curve concave northwesterly and having a radius of 30 feet, a radial line bearing N 28° 31' 21" E passes through said point; thence S 61° 28' 39" E, 218.00 feet along the north right of way line of old Santa Ana Canyon Road to the beginning of a curve con- cave northeasterly and having a radius of 820 feet, a radial line bearing S 28° 31' 21" W passes through said point; thence Southeasterly along said curve through a central angle of 0° 44' 14 an arc distance of 10.55 feet; thence S 1° 50' 03" W, 66.20 feet to an intersec- tion with the south right of way line of said old Santa Ana Canyon Road, 60.00 feet wide, said intersection being a point in a curve concave southwesterly and hav- ing a radius of 880 feet, a radial line bearing N 25° 53' 56" E passes through said point; thence Northwesterly along said curve through a central angle of 2° 37' 25 an arc distance of 40.30 feet; thence N 61° 28' 39" W, 218.00 feet to a point in a curve concave northwesterly and having a radius of 30 feet, a radial line bearing S 28° 31' 21" E passes through said point; thence East- erly, Northeasterly, Northerly and Northwesterly along said curve through a central angle of 180° 00' 00 an arc distance of 94.25 feet to the point of beginning. Reserving therefrom an easement for sanitary sewer pur- poses over, under and across the westerly 20 feet of Lot 8 in Tract No. 936 and northerly prolongation of the west line of said Lot 8, as shown on a map recorded in Book 30, pages 1 and 2, Miscellaneous Maps, records of said Orange County. -2- ATTEST: Reserving unto the Pacific Telephone Company an easement over, under and across the northerly 10 feet thereof to construct, place, operate, inspect, maintain, repair, replace, and remove such aerial and underground telephone and telegraph and communication structure as the Company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, marker and necessary fixtures and appurtenances. Reserving unto the Southern California Gas Company an easement over, under and across the northerly 10 feet thereof to accommodate existing Gas Company facilities. AND BE IT FURTHER RESOLVED that the City Clerk be and she is hereby authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Anaheim, to be recorded in the Office of the County Recorder of Orange County, California.
