RESOLUTION NO. 74R -139
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM FINDING AND DETERMINING THAT TITLE
18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO
ZONING SHOULD BE AMENDED AND THAT THE BOUND-
ARIES OF CERTAIN ZONES SHOULD BE CHANGED.
WHEREAS, the City Planning Commission of the City
of Anaheim did hold a public hearing in Reclassification Pro-
ceedings No. 73 to consider an amendment to Title 18 of
the Anaheim Municipal Code relating to zoning, and to consider
a change in the boundaries of the zone or zones hereinafter
mentioned and described, and at said hearing did receive evidence
and reports from persons interested therein and from its staff;
and
WIIEREAS, within a period of forty days following said
hearing, the Planning Commission did duly adopt a resolution-
containing a report of its findings, a summary of the evidence
presented at said hearing, and a recommendation that the proposed
amendment be adopted by the City Council and that a certain zone
or zones be changed as hereinafter set forth; and
WHEREAS, upon receipt of said resolution, summary of
evidence, report of findings and recommendation of the City
Planning Commission the City Council did fix the 2nd day of
April 1974 and continued to the day of
19 as the time, and the City Council Chambers in the City
Hall of the City of Anaheim as the place for a public hearing
upon said proposed amendment to Title 18 of the Anaheim Municipal
Code, and the exclusion of said property, hereinafter described,
from the zone or zones in which it is now situated and the incor-
poration thereof in the zone or zones hereinafter set forth, and
did give notice thereof in the manner and form provided in said
Title 18 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing the City Council did hold and conduct such public hearing
and did give all persons interested therein an opportunity to be
heard, and did receive evidence and reports, and did thereupon
consider the summary of evidence presented at said public hearing
before the Planning Commission, its report of findings and
recommendation; and
WHEREAS, the City Council does find and determine that
the amendment to Title 18 of the Anaheim Municipal Code should
be adopted and that the property hereinafter described should
be excluded from the zone or zones in which it is now situated
and incorporated in the zone or zones as hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Title 18 of the Anaheim Municipal Code
be, and the same is hereby, amended and that the following
described property, situated in the City of Anaheim, County of
Orange, State of California, to wit:

PARCEL 1
That portion of the Southwest quarter of the Southwest
quarter of Section 23, Township 4 South, Range 10 West,
in the Rancho San Juan Cajon de Santa Ana, City of
Anaheim, County of Orange, State of California, as
shown on a map recorded in book 51, page 10 of Miscel-
laneous Maps, in the office of the county recorder of
said county, described as follows:
Beginning at the Easterly terminus of the course shown
as South 81° 11' 30" West, 358.12 feet within Parcel 1
of the State Highway Relinquishment No. 525 recorded
December 27, 1966 in book 8136, page 345 of Official
Records; thence along the boundary of said relinquishment
the following courses; South 81° 11' 30" West 358.12
feet to the beginning of a curve concave Easterly having
a radius of 55.00 feet, Westerly, Southwesterly and
Southerly 77.97 feet along said curve through a central
angle of 81° 13' 45 South 0° 02' 15" East 14.38 feet to
a point on a non tangent curve concave Northerly having a
radius of 100.00 feet, a radial to said point bears South
29° 57' 45" West, Easterly 52.37 feet along said curve
through a central angle of 30° 00' 30 North 89° 57'
45" East 407.68 feet, North 0° 02' 15" feet to a point on
a non tangent curve concave Southwesterly having a radius
of 970.00 feet a radial to said point bears North 55° 50'
22" East, Northwesterly 95.13 feet through a central angle
of 5° 37' 08" to the point of beginning.
PARCEL 2:
That portion of the Southwest quarter of the Southwest
quarter of Section 23, Township 4 South, Range 10 West, in
the Rancho San Juan Cajon de Santa Ana, City of Anaheim,
County of Orange, State of California, as per map recorded
in book 51, page 10 of Miscellaneous Maps, in the office
of the County Recorder of said County, described as follows:
Beginning at the Easterly terminus of the Northerly line of
that certain parcel of land bounded completely on all sides
by Parcel 1 of State Highway Relinquishment No. 525, as
shown on the map filed in book 4, pages 3 and 4 of Highway
Maps in the office of the Recorder of said county, said
Northerly line shown as having a bearing and distance of
South 81° 11' 30" West 358.12 feet; thence along said
Northerly line and the various courses in the boundary of
said land, South 81° 11' 30" West 358.12 feet to the
beginning of a tangent curve concave to the Southeast
having a radius of 55 feet; thence along said curve through
a central angle of 81° 13' 45" an arc distance of 77.97 feet;
thence tangent to said curve, South 0° 02' 15" East 14.38
feet to the beginning of a nontangent curve concave to the
Northeast having a radius of 100 feet a radial line through
said beginning of curve bears North 29° 57' 45" East; thence
along said curve through a central angle of 30° 00" 30" an
arc distance of 52.37 feet to the Westerly terminus of the
Southerly line of said parcel of land having a bearing and
distance of North 89° 57' 45" East 407.68 feet; thence leav-
ing the boundary of said Parcel of land, along curve
tangent to said Southerly line and concave to the Northeast

30' 00" an arc distance of 53.28 feet to a point of compound
curve, a radial line through said point bears South 18° 27'
15" West; thence along said compound curve having a radius of
36 feet through a central angle of 130° 02' 45" an arc
distance of 81.71 feet, a radial line through the end of said
curve bears North 31° 30' 00" West; thence tangent to
said curve North 58° 30' 00" East 57.00 feet; thence
North 81° 58' 20" East 287.03 feet to the beginning
of a tangent curve concave to the Northwest having a
radius of 41 feet; thence along said curve through a
central angle of 87° 38' 15" an arc distance of 62.71
feet; a radial line through the end of said curve
bears North 84° 20' 05" East; thence along a nontangent
line South 39° 46' 46" East 66.19 feet to the point of
beginning.
be excluded from R -A, AGRICULTURAL ZONE, and incorporated in
C -1, GENERAL COMMERCIAL ZONE, subject to the following
conditions:
1. That all engineering requirements of the City of
Anaheim along Katella Way and Manchester Avenue, including
preparation of improvement plans and installation of all improve-
ments such as curbs and gutters, sidewalks, street grading and
paving, drainage facilities, or other appurtenant work shall be
complied with as required by the City Engineer and in accordance
with standard plans and specifications on file in the office of
the City Engineer; that street lighting facilities along Katella
Way and Manchester Avenue shall be installed as required by the
Director of Public Utilities and in accordance with standard
plans and specifications on file in the office of the Director
of Public Utilities; and that a bond in an amount and form satis-
factory to the City of Anaheim shall be posted with the City
to guarantee the installation of the above- mentioned requirements.
2. That sidewalks shall be installed along Katella
Avenue as required by the City Engineer and in accordance with
standard plans and specifications on file in the office of the
City Engineer.
3. That driveways shall be reconstructed along
Katella Avenue as required by the City Engineer and in accordance
with standard plans and specifications on file in the office of the
City Engineer.
4. That the owner of subject property shall pay to the
City of Anaheim the sum of sixty cents per front foot along
Katella Way and Manchester Avenue for tree planting purposes.
5. That trash storage areas shall be provided in
accordance with approved plans on file with the office of the
Director of Public Works.
6. That fire hydrants shall be installed and charged
as required and determined to be necessary by the Chief of the
Fire Department prior to commencement of structural framing.
7. That all air- conditioning facilities shall be
properly shielded from view and the sound buffered from adjacent
private properties.

8. That subject property shall be served by under-
ground utilities.
9. That drainage of subject property shall be disposed
of in a manner satisfactory to the City Engineer.
10. That completion of these reclassification pro-
ceedings is contingent upon the granting of Conditional Use
Permit No. 1456.
11. That appropriate water assessment fees as deter-
mined by the Director of Public Utilities shall be paid to the
City of Anaheim prior to the issuance of a building permit.
12. That subject property shall be developed substan-
tially in accordance with plans and specifications on file with
the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5, 6, 7, 8,
and 9; provided, however, that the easterly driveway providing
access to Manchester Avenue shall be located as far south as
possible and at a location duly approved by the City Engineer,
and that the signing shall not exceed 60 feet in height.
13. Prior to the introduction of an ordinance rezoning
subject property, Conditions Nos. 1 and 4, above- mentioned, shall
be completed. The provisions or rights granted by this resolution
shall become null and void by action of the City Council unless
said conditions are complied with within one year from the date
hereof, or such further time as the City Council may grant.
14. That Conditions Nos. 2, 3, 5, 7, 8, 9 and 12,
above mentioned, shall be complied with prior to final building
and zoning inspections.
BE IT FURTHER RESOLVED that the City Attorney be, and
he is hereby authorized and directed to prepare and submit to
the City Council an ordinance amending Title 18 of the Anaheim
Municipal Code to accomplish the objects herein found and
determined to be necessary and proper.
THE FOREGOING RESOLUTION is approved and signed by me
this 2nd day of April, 1974.
