1974-135ATTY 18 -C (Page 1 of 1 page) RESOLUTION NO. 74R 135 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAIHEIM FINDING AND DETERMINING TIIAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 2nd day of April 1974 and continued to the day of 19 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 73 -74 -43 PARCEL 1: All that portion of the Southwest quarter of the Southwest quarter of Section 23, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a map recorded in book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the North line of the South- west quarter of the Southwest quarter of said Section 23, 288.34 feet West of the Northeast corner of said Southwest quarter; thence South 45° West 722.10 feet to a point in the center line of the State Highway as conveyed to the State of California by Deed recorded July 10, 1914 in book 258, page 66 of Deeds; thence Northwesterly along the center line of said State Highway 498.5 feet to a point 125 feet South of a point 198 feet East of the Northwest corner of the Southwest quarter of the Southwest quarter of said Section 23, thence North 125 feet to the North line of said Southwest quarter; thence East 833.66 feet to the point of beginning. Excepting therefrom the right of way for a railroad as conveyed to the Pacific Improvement Company, a corporation, by deed recorded June 26, 1888 in book 461, page 21 of Deeds, records of Los Angeles County, California. Also excepting therefrom a plot of ground near the Northwest corner of said land, being a plot 60 feet North and South and 30 feet East and West, upon which a pumping plant is located. Also excepting therefrom that portion of said land conveyed to Louis W. Baggott and wife by deed recorded October 9, 1926 in book 684, page 8 of Deeds, descri- bed as follows: Beginning at the point of intersection of the center line of the State Highway as it existed on October 9, 1926 with the Southeasterly line of the tract of land formerly owned by Alva E. Hargrove and Elizabeth Har- grove, said point being South 45° West 722.10 feet from a point 288.34 feet West of the Northeast corner of the Southwest quarter of the Southwest quarter of said Section 23; thence Northwesterly along said center line of the State Highway 211 feet; thence North 45° East 257.75 feet; thence Southeasterly 211 feet, more or less, to a point in said Southeasterly line of the land owned by Hargrove 273.5 feet North 45° East of the point of beginning; thence South 45° West 273.5 feet along said line to the point of beginning. Also excepting therefrom that portion as described in the deed to the State of California, recorded November 9, 1964 in book 7293, page 770 of Official Records. -2- PARCEL 2: All that portion of the West half of the Southwest quarter of Section 23, Township 4 South, Range 10 West, S.B.B. M., described as follows: A strip of land 50 feet wide in said Section 23, being that portion of the 50 -foot strip of land described in the deed from Pacific Improvement Company to Southern Pacific Railroad Company, dated May 28, 1889, recorded June 27, 1889 in book 570, page 288 of Deeds, records of Los Angeles County, California, bounded as follows: On the West by the center line of the California State Highway (Route VII Ora -2 -D) as conveyed to the State of California by deed recorded July 10, 1914 in book 298, page 66 of Deeds, being a curve concave Easterly, having a radius of 800 feet and an arc length of 567.23 feet, as shown on a map filed in the State Highway Map Book No. 1, page 72 -A in the office of the County Recorder of Orange County, California and bounded on the East by the East line of the West half of the Southwest quarter of said Section 23. PARCEL 3: All that certain land situated in the State of California, County of Orange, City of Anaheim, described as follows: That portion of the Northwest quarter of the South- west quarter of Section 23, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana as shown on a Map thereof recorded in Book 51, Page 10 of Miscellaneous Maps, records of said Orange County, lying Southeasterly of the Southeasterly line of the land described in deed to Alva E. Hargrove and wife, recorded September 22, 1943 in Book 1206, Page 528 of Official Records of said County. be excluded from C -3, HEAVY COMMERCIAL ZONE, and incorporated in M -1, LIGHT INDUSTRIAL ZONE, subject to the following conditions: 1. That the alignment of the west property line, adjacent to Anaheim Boulevard, shall be approved by the California Division of Highways. 2. That sidewalks shall be installed along Anaheim Boulevard as required by, the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Anaheim Boulevard for street lighting purposes. 4. That the owners of subject property shall pay to the City of Anaheim the sum of sixty cents per front foot along Anaheim Boulevard for tree planting purposes. -3- 5. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 6. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 7. That subject property shall be served by under ground utilities. 8. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 9. That a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 10. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 11. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3. 12. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1, 3, and 4, above- mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 13. That Conditions Nos. 2, 5, 7, 8, 9, and 11, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de to be necessary and proper.
