RESOLUTION NO. 74R- 119
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH EUCLID SHOPPING CENTER (SE
Corner Euclid and Katella) (73 -16E).
WHEREAS, Euclid Shopping Center, a corporation,
hereinafter referred to as Licensee, is the owner of prop-
erty in the City of Anaheim over which the City has a road
and public utility easement; and
WHEREAS, Licensee wishes to encroach upon a por-
tion of said easement for the purpose of installation and
maintenance of landscaping and sprinkler system; and
WHEREAS, unless Licensee is allowed to encroach upon
the easement of the City, an extreme and undue hardship will
be caused to them; and
WHEREAS, the proposed encroachment for such installa-
tion across a portion of the easement of City will not inter-
fere with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Euclid
Shopping Center be, and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are authorized to execute said license agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 19th day of March, 1974.
