90-438 RESOLUTION NO. 90R-438 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 3126 AND AMENDING RESOLUTION NO. 89R-167. WHEREAS, the City Council of the City of Anaheim heretofore adopted Resolution No. 89R-167 approving Conditional Use Permit No. 3126, subject to certain conditions specified therein; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the city Council held a duly noticed public hearing on December 11, 1990, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the city Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 3126 be, and the same are hereby, amended by: 1. Amending the tenth paragraph on Page 2 of Resolution No. 89R-167 to read as follows: " NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Conditional Use Permit No. 3126 be, and the same is hereby granted, permitting expansion of an automobile, truck and commercial vehicle (not to exceed two [2} axles in size) repair facility provisions of the Anaheim Municipal Code: SECTIONS 18.06.050.0132 - Minimum number of 18.06.080 Darkin~ spaces. and 18.45.066.050 (30 required; 21 proposed)" 2. Adding new Condition No. 18 to Conditional Use Permit No. 3126 as set forth in Resolution No. 89R-167 to read as follows: "18. That the maximum size of any trucks or commercial vehicles to be repaired shall not exceed two (2) axles." CUP #3126 BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution No. 89R-167 shall remain in full force and effect. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this llth day of December, 1990.
