A RESOLUTION OF THE CITY
CITY OF ANAHEIM GRANTING
IN PART.
74R -80
COUNCIL OF THE
VARIANCE NO. 2570
WHEREAS, after a request for variance by David
R. Doering, owner, was received, a public hearing before
the Planning Commission of the City of Anaheim was held
upon due and proper notice as a result of which Variance
No. 2570 was granted in part, covering the following
described property:
Lots 11, 12, 13, 14, 15 and 16, in Block 3 of
Summerfield and Oppenheimer's Subdivision of
the Spoerl Tract, in the City of Anaheim,
County of Orange, State of California, as per
map thereof recorded in book 19, page 44,
Miscellaneous Records of Los Angeles County,
California.
WHEREAS, thereafter, within the time prescribed by
law an interested party or the City Council on its own motion
caused the review of said Planning Commission action at a
public hearing noticed and held as prescribed by law and as
a result thereof the City Council does hereby make the follow-
ing findings:
1. That there are special circumstances applicable
to the property, including size, shape, topography,
location or surroundings, which do not apply to
other property under identical zoning classifica-
tion in the vicinity.
2. That, because of special circumstances shown in
(1) above, strict application of the zoning code
deprives the property of privileges enjoyed by
other property under identical zoning classifica-
tion in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim, that a conditional zoning variance be, and
the same is hereby granted permitting a commercial parking lot
on the aforedescribed property with waivers of the following
Section of the Anaheim Municipal Code:
SECTION 18.32.020(1) Permitted Uses. (Parking
lot not permitted in R -3
Zone; parking lot proposed)
that said variance be granted, in part, subject to the following
conditions:
1. That the owner(s) of subject property shall deed
to the City of Anaheim a strip of land 10 feet in width from the
centerline of the alley for alley widening purposes.

2. That drainage of subject property shall be
disposed of in a manner satisfactory to the City Engineer.
3. That street lighting facilities along Diamond
Street shall be installed as required by the Director of Public
Utilities, and in accordance with standard plans and specifica-
tions on file in the office of the Director of Public Utilities
and that a bond in an amount and form satisfactory to the City
of Anaheim shall be posted with.the City to guarantee the instal-
lation of the above- mentioned requirements.
4. That subject property shall be developed substan-
tially in accordance with plans and specifications on file with
the City of Anaheim marked Exhibit No. 1.
5. That Conditions Nos. 1, 2, 3 and 4, above
mentioned, shall be complied with prior to the commencement of
the activity ailthorized under this resolution, or prior to the
time that the building permit is issued, or within a period of
one year from date hereof, whichever occurs first, or such further
time as the City Council may grant.
6. That the subject parking lot shall be closed and
prohibited from use after one hour following the closing time of
The Marquis cocktail bar.
BE IT FURTHER RESOLVED that the City Council hereby
reserves the right to revoke such variance permit for good
cause or failure of said owner, his heirs, successors or assigns
to comply with the Anaheim Municipal Code and regulations and
the conditions herein. Said variance is granted for the term
prescribed by the Anaheim Municipal Code unless otherwise speci-
fied herein.
THE FOREGOING RESOLUTION is approved and signed by me
this 26th day of February, 1974.
