1974-078RESOLUTION NO. 74R -78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2568. WHEREAS, after a request for variance by LEROY and SUSAN HEITMAN, owners, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2568 was granted covering the following described property: PARCEL 1: The East 132.00 feet of the South half of the Southwest quarter of the Southwest quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County. PARCEL 2; All that portion of the South half of the Southwest quarter of the Southwest quarter of the South- east quarter of Section 14, Township 4 South, Range 11 West, San Bernardino Base and Meridian, in the City of Anaheim, lying East of the East line of the land des- cribed in the deed from E. E. Miles and wife, to Severiano J. Perez, recorded February 10, 1950, in book 1966, page 548, Official Records. EXCEPTING THEREFROM the East 132 feet thereof. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a pub- lic hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings; 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a two story, 50 -unit apartment complex on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.28.050(5 -b) -1- Maximum height within 150 feet of any single- family residential zone. (1 -story permitted, 2 -story proposed). FAL:kw SECTION 18.28.050(6 -b -1) SECTION 18.28.050(7-a) That said variance be granted subject to the following condi- tions: 1. That this variance is granted subject to the completion of Reclassification No. 73- 74 -29. 2. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1, Revision No. 2; and Revision No. 1 of Exhibits Nos. 2, 3 and 4; providing, how- ever, that a 6 -foot high masonry wall shall be provided along the north property line; and that said' 6-foot wall shall be con- tinued westerly of the north property line of subject property, to the full width of that R -1 parcel which partially abuts sub- ject property at the nrothwest boundary, as stipulated to by the petitioner. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regula- tions and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless other- wise specified herein.
