1974-066RESOLUTION NO. 74R- 66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF CERTAIN REAL PROPERTY DESCRIBED HEREIN AND RESERVING THEREFROM A CERTAIN EASEMENT FOR PUBLIC UTILITY PURPOSES. WHEREAS, the City Council of the City of Anaheim did on the 29th day of January, 1974, declare by Resolution No. 74R -34 its intention to vacate and abandon the aboveground portion of an existing easement located northerly of Freedman Way, east of Harbor Boulevard, in the City of Anaheim, subject to reservation of underground public utility easement together with all surface rights of entry, ingress and egress to accom- modate existing underground facilities, more fully hereinafter described, and did set the 19th day of February, 1974, for a public hearing thereon; and WHEREAS, the City Council finds from the evidence submitted at said public hearing that that portion of the real property described herein and in said Resolution of Inten- tion is unnecessary for present or prospective public utility purposes but that a certain public utility easement should be reserved therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds that said public hearing was properly held and that all notices were given and publications made as required by law. 2. That that portion of the real property toward which a request for vacation and abandonment was directed is not necessary for present or prospective public utility purposes and does hereby order that said portion, as herein set forth, be and it is hereby vacated, abandoned and closed to public use, subject to the reservation of underground public utility easement hereinabove described. 3. That said portion of real property herein ordered vacated, abandoned and closed to public use is situa- ted in the City of Anaheim, County of Orange, State of California, and is more particularly described as follows, to wit: The aboveground portion of that certain public utility easement to be abandoned located in the City of Anaheim, County of Orange, State of California, described in deed recorded November 18, 1964 in Book 7307, page 825, Official Records of said Orange County, described as follows: The easterly 10 feet of the westerly 395 feet of the northerly 325 feet of the southerly 500 feet of Lot 20 in Tract No. 190, as shown on a map recorded in Book 23, page 50, Miscellaneous Maps, records of said Orange County, California. -1- 73 -6A 4. That the City Council finds that that certain under- ground easement, more fully hereinbefore set forth, should be reserved for public utility purposes. AND BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized and directed to cause a certified copy of this Resolution and Order, attested by her under the seal of the City of Anaheim, to be recorded in the Office of the County Recorder of Orange County, California.
