A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING A STANDARD
CONDITION CONTAINED IN VARIOUS RESOLUTIONS
OF INTENT TO RECLASSIFY PROPERTY IN THE
CITY OF ANAHEIM.
WHEREAS, the City Council has reclassified the
zoning of property by resolutions of intent; and
WHEREAS, the resolutions of intent to rezone
have contained various conditions that require completion
thereof in order to have ordinance of rezoning read on the
property described in said resolutions; and
WHEREAS, many of said resolutions contained a
standard condition reading as follows:
"That the owners of subject property shall pay to
the City the sum of $2.00 per front foot for
street lighting purposes, said amount to be paid
at the time the property is developed;" and
WHEREAS, because of increased cost of lighting
construction, shortage of available City manpower, and
general inflation, the street lighting work specified in
said condition cannot be installed by City crews.
WHEREAS, to avoid increased taxes, and provide for
the best interests of the citizens of the City, it is
necessary to place the cost of street lighting on those
persons deriving the most direct benefit therefrom; and
WHEREAS, the City Council has found it in the best
interest of the City of Anaheim to amend said condition in
all resolutions of intent to reclassify property to read as
follows:
"That the owner of the subject property shall install
street lighting as required by the Utilities Director
except when the Utilities Director shall permit the
payment of street lighting fees in the amount of $2.00
per front foot."
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that in all cases where a resolution
of intent to reclassify property where a Zoning Ordinance has
not been passed by the City Council and said resolution
contains a condition requiring the payment of a sum for street
lighting purposes, that said condition be, and the same is
hereby amended to read as follows:
"That the owner df the subject property shall install
street lighting as required by the Utilities Director
except when the Utilities Director shall permit the
payment of street lighting fees in the amount of $2.00
per front foot."

BE IT FURTHER RESOLVED that except as hereby
expressly amended, all said resolutions shall remain in full
force and effect.
THE FOREGOING RESOLUTION is approved and signed by
me this 29th day of January, 1974.
