1974-021PARCEL 1 of 3: RESOLUTION NO. 74R -21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1430, IN PART. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on December 10, 1973, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC 73 -255 granting Conditional Use Permit No. 1430, in part; and -4- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting, in part, said conditional use permit and did thereupon fix the 22nd day of January, 1974, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notice of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting, in part, said conditional use permit be, and the same is hereby sustained, and that Conditional Use Permit No. 1430 be, and the same is hereby, granted permitting the establishment of a 157 lot planned unit development on the aforedescribed property with waivers of the following sections of the Anaheim Municipal Code: -5- SECTION 18.08.440 SECTION 18.28.050(5 -b) Maximum building height within 150 feet of an R -A Zone. (One story permitted; two -story proposed) SECTION 18.28.050(1 -a) Minimum building site area. (7200 square feet required; 2992 square feet proposed) SECTION 18.28.050(1 -b) Minimum building site width. (70 feet required; 34 feet proposed) SECTION 18.28.050 (6 -b -3) Required frontage of lots on a dedicated street. (Frontage on private drives proposed) Minimum side yard setback. (5 feet required; 4 feet proposed) SECTION 18.28.050(11) Required masonry wall abutting a single family residential zone. (Wall required; none proposed) That said conditional use permit be granted, in part, subject to the following conditions: 1. That this conditional use permit is granted, in part, subject to the completion of Tentative Map of Tract Nos. 8513, 8514, 8515, 8516 and Reclassification No. 71- 72 -44, now pending. 2. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 3. That the covenants, conditions and restrictions shall be submitted to and approved by the City Attorney's Office prior to City Council approval of the final tract maps and, further, that the approved covenants, conditions and restrictions shall be recorded concurrently with the final tract maps. 4. That prior to filing the final tract maps, the applicant shall submit to the City Attorney for approval or denial a complete synopsis of the proposed functioning of the operating corporation including, but not limited to, the articles of incorporation bylaws, proposed methods of management, bonding to insure maintenance of common property and buildings, and such other information as the City Attorney may desire to protect the City, its citizens, and the purchasers of the project. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 7. That subject property shall be served by under- ground utilities. -6- 8. That a perpetual maintenance agreement covering the Metropolitan Water District water easement shall be submitted to the City Attorney's Office for approval and provisions for perpetual maintenance for the Metropolitan Water District ease- ment shall be included in the covenants, conditions and restric- tions. After approval, said agreement shall be recorded with the Orange County Recorder. 9. That subject property .shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, 4, 5, 6, 7, 8 and 9. 10. That Conditions Nos. 1, 2, 3, 4 and 8, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission may grant. 11. That Conditions Nos. 6, 7,. and 9, above mentioned, shall be complied with prior to final building and zoning inspections. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
