1974-375RESOLUTION NO. 74R -375 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2612. WHEREAS, after a request for variance by The William Lyon Company, owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, as a result of which Variance No. 2612 was granted covering the following described property: Beginning at the most easterly North corner of Tract No. 7416 in the City of Anaheim, recorded in Book 311, Pages 37 to 42 inclusive of Miscellaneous Maps in the Office of the County Recorder of Orange County; said northeasterly corner being also in the northeasterly boundary of said City of Anaheim; thence along said northeasterly boundary and Tract line, North 73 42' 35" West 10.62 feet to the beginning of a tangent curve, concave northeasterly and having a radius of 867.88 feet; thence northwesterly along said boundary line and curve through a central angle of 49° 23' 21" and an are distance of 748.11 feet to the end of said curve, thence tangent to said curve, along said bound- ary, North 24 19' 14" West 846.14 feet to the most northerly corner of said Tract No. 7416; being also an angle point in said boundary; thence continuing along said boundary, North 51 28' 17" West 534.22 feet to an angle point therein, being along a curve having a radius of 20.00 feet through an arc length of 34.00 feet and South 53 23' 45" West 20.00 feet and North 56 28' 17" West 20.00 feet and South 38° 31' 43" West 160.00 feet to the northwesterly terminus of that cer- tain course described above as having a bearing and length of North 24° 19' 14" West 846.14 feet. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing, noticed and held as prescribed by law, and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted permitting a 26 -unit RS -5000 zoned single family residential development on Portion "A" and a 170 unit multiple family residential development on Portion "B" with waivers of the following Anaheim Municipal Code provision as to Portion "B" only. SECTION 18.28.050(5 -b) Maximum permitted height within 150 feet of an R -A Zone. (One -story permitted; two -story proposed) SECTION 18.28.050(11) Required masonry wall abutting an R -A Zone. (Six -foot high masonry wall required; none proposed) that said variance be granted subject to the following conditions: 1. That this variance is granted subject to the comple- tion of Reclassification No. 73- 74 -6 now pending. 2. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 23. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 6th day of August, 1974.
