A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RESOLUTION NO. 69R -606, PERSONNEL RULE 7,
APPOINTMENTS AND PROMOTIONS, SECTION 7.2, RELATING TO
EXTENDING EQUAL EMPLOYMENT OPPORTUNITY PROVISIONS TO
INCLUDE PROHIBITION OF DISCRIMINATION BASED ON SEX OR
AGE, EXCEPT WHERE SEX OR AGE IS A BONA FIDE OCCUPATIONAL
QUALIFICATION.
WHEREAS, the Equal Employment Opportunity Act of 1972 and the
Fair Labor Standards Act of 1938, as amended, extend coverage of federal
equal employment opportunity provisions to municipal governments, and
WHEREAS, federal provisions prohibit discrimination based on sex
or age, except where sex or age is a bona fide occupational qualification, and
WHEREAS, the need exists to amend Resolution No. 69R -606, Rule 7,
Section 7.2 which established appointment and promotion provisions, and
WHEREAS, the City Council of the City of Anaheim does find that
adoption of the recommended equal employment opportunity provisions is in
the best interests of the City of Anaheim
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim'that Resolution No. 69R -606, Rule 7, Section 7.2 be and the same
is hereby amended to read as follows:
"RULE 7. APPOINTMENTS AND PROMOTIONS
Section 7.2 Examinations for appointments and promotions shall be
in such form as will fairly test the abilities and aptitudes of
candidates for the duties to be performed, so that such appointments
and promotions will be solely based on qualifications without regard
to race, color, national origin, religious or political affiliation
or belief, membership in or attitude toward any employee organization,
sex or age, except where sex or age is a bona fide occupational
qualification."
