RESOLUTION NO. 74R- 333
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF A REIMBURSEMENT AGREEMENT BETWEEN THE CITY
OF ANAHEIM AND AMERICAN NATIONAL HOUSING COR-
PORATION PERTAINING TO THE INSTALLATION OF A
WATER SYSTEM FOR TRACT NO. 7470 AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SAID AGREEMENT
FOR AND ON BEHALF OF THE CITY OF ANAHEIM.
WHEREAS, the City of Anaheim has provided in Rule 15
of its Water Rates and Regulations that a secondary water dis-
tribution system will be paid for and installed by the owners
of the property that the system serves; and
WHEREAS, Rule 15 -5a provides that, where a secondary
distribution system must be extended to a new development, the
system will be paid for and installed by the developer of the
property to which the system is extended; and, if the system
will later serve additional property, the City will collect and
return to the developer a proportionate cost of the system
serving the additional property when such property is developed;
and
WHEREAS, American National housing Corporation has
developed Tract No. 7470 in the City of Anaheim; and
WHEREAS, the Water Division of the Utilities Depart_ent
of the City of Anaheim has determined that the extension of the
secondary water distribution system to said Tract 7470 will per-
mit connection by the property fronting on Solomon Drive, between
Santa Ana Canyon Road and Camino Manzano; and
WHEREAS, the Water Division of the Utilities Department
of the City of Anaheim has also determined that a future developer
of property fronting on Solomon Drive, between Santa Ana Canyon
Road and Camino Manzano should be required to pay Five Dollars
and Thirteen Cents ($5.13) per front foot for the connection to
said secondary water distribution system in addition to any other
fees for the purpose of reimbursing American National Housing
Corporation for construction of said system.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agree-
ment between the City of Anaheim and American National Housing
Corporation providing for the reimbursement of corporation be
and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
of the City of Anaheim are hereby authorized to execute said
agreement on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 9th day of July 1974.
