1974-273ATTY 18 -C (Page 1 of 1 page) RESOLUTION NO. 74B -273 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73 -74 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WIIEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the llth day of June 19 714 and continued to the day of 19 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 73 -74 -57 Those portions of Lot 5 of Miles Rancho, in the City of Anaheim, as shown on a map thereof recorded in Book 4, page 7, Miscellaneous Maps, records of said Orange County, described as follows: PARCEL 1: The Westerly 280 feet of the Southerly 239.66 feet of the following described land: Beginning at the intersection of the centerlines of those certain unnamed roads on the Westerly and South- erly sides of said Lot 5 as shown on said map, said roads now known as Harbor Boulevard and Romneya Drive; thence North, along said centerline of Harbor Boule- vard 239.66 feet to the Westerly prolongation of the South line of the land described in the deed to Arn- old Construction Co., a corporation, recorded July 18, 1955, in book 3142, page 230, Official Records; thence along said prolongation and the Southerly and Easterly lines of said land, North 89° 54' 00" East 280.00 feet and North 130.00 feet to the Northwest corner of the land described in the deed to Carl N. Karcher and wife, recorded March 22, 1962, in book 6048, page 202, Offi- cial Records; thence along the Northerly and Easterly lines of said land to Karcher, the Easterly line of the land described in the deed to Carl Karcher Enter- prises, a California corporation, recorded August 21, 1953, in book 2559, page 519 of said Official Records, and the Westerly line of the land described in the deed to Joseph W. Heinz and wife, recorded August 21, 1953, in book 2559, page 515, of said Official Records, North 89° 54' 00" East 231.41 feet, and South 369.66 feet to the said centerline of Romneya Drive; thence South 89° 54' 00" West 511.41 feet to the point of be- ginning. EXCEPTING THEREFROM the Westerly 150 feet thereof. PARCEL 2: The Southerly 189.50 feet of the Southerly 239.66 feet of the following described land: Beginning at the intersection of the centerlines of those certain unnamed roads on the Westerly and South- erly sides of said Lot 5 as shown on said map, said roads now known as Harbor Boulevard and Romneya Drive; thence North, along said centerline of Harbor Boulevard 239.66 feet to the westerly prolongation of the South line of the land described in the deed to Arnold Con- struction Co., a corporation, recorded July 18, 1955, in book 3142, page 230, Official Records; thence along said prolongation and the Southerly and Easterly lines of said land, North 89 54' 00" East 280.00 feet and North 130.00 feet to the Northwest corner of the land described in the deed to Carl N. Karcher and wife by deed recorded January 3, 1962 in book 5963, page 894 of Official Records; thence North 89° 54' 00" East along the North line of said land, 231.41 feet to the West boundary of the land conveyed to Freedom Newspaper Inc., recorded Feb ruary 14, 1964 in book 6923, page 184 of Official Rec- ords; thence North along said West line to the North- erly line of the land of Joseph William Heinz as des- cribed. in Certificate of Title No. 2117 on file in the -3- office of the Registrar of Titles of said County; thence South 74 27' 44" West along said Northerly line to the Northeasterly corner of the land conveyed to Arnold Construction Co., a corporation, by deed re- corded September 27, 1963 in book 6735, page 247 of Official Records; thence South along the Easterly line of said land to the point of beginning. be excluded from M -1, LIGHT INDUSTRIAL ZONE and incorporated in C -2, GENERAL COMMERCIAL ZONE subject to the following conditions: 1. That sidewalks shall be installed along Romneya Drive as required by the City Engineer and in accordance with standard plans and specific- ions on file in the Office of the City Engineer. 2. That street lighting facilities along Romneya Drive shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot along Rom neya Drive for tree planting purposes. 4. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That all air- conditioning facilities shall be prop- erly shielded from view, and the sound buffered from adjacent prop erties. utilities. 7. That subject property shall be served by underground 8. That the property shall be developed to meet the site development standards of the C -1, GENERAL COMMERCIAL ZONE. 11. That subject property shall be developed substanti- ally in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3 and 4. -4- 12. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 2, 3, and 9, above mentioned, shall be completed. The provisions or rights granted by this reso- lution shall become null and void by action of the City Council un- less said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 13. That Condition Nos. 1, 4, 6, 7, 8, 10 and 11, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that. the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
