A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH MARTIN LUTHER ASSOCIATION
(73 -20E).
WHEREAS, Martin Luther Association, a non profit cor-
poration, hereinafter referred to as Licensee, is the owner
of property in the City of Anaheim over which the City owns
a public utility easement; and
WHEREAS, Licensee wishes to encroach upon a portion
of said easement for the purpose of installing a private 8
V.C.P. sewer force main at Romneya Drive, west of Euclid; and
WHEREAS, unless Licensee is allowed to encroach upon
the easement of the City, an extreme and undue hardship will
be caused to it; and
WHEREAS, the proposed encroachment for such installation
across a portion of the Easement of City will not interfere
with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Martin Luther Associa-
tion, a non- profit corporation, be and the are is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are authorized to execute said license agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 4th day of June, 1974.
