1974-615RESOLUTION NO. 74R -615 A RESOLUTION OF THE CITY COUNCIL'OF THE CITY OF ANAHEIM, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, MARCH 4, 1975, FOR THE PURPOSE OF SUBMITTING A PROPOSITION FOR THE ISSUANCE OF ELECTRIC REVENUE BONDS BY SAID CITY, AND CONSOLIDATING SAID ELECTION WITH VARIOUS SCHOOL DISTRICT ELECTIONS TO BE HELD ON SAID DATE. The City Council of the City of Anaheim, California DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. A special election is called to be held in the City of Anaheim, California, on Tuesday, March 4, 1975, for the purpose of submitting to the qualified voters of said City a proposition for the issuance of electric revenue bonds pursuant to Section 1210 of the Charter of said City and the Revenue Bond Law of 1941 (Chapter 6, Part 1 Division 2, Title 5 of the Government Code of the State of California) in the amount and for the purpose hereinafter set forth. Section 2. The purpose for which the bonds are proposed to be issued is to finance the construction and :cqui siti_on of facilities, property and rights related to tl}e generation, traT?smission and distribution of electrical energy. Section 3. The estimated cost of the acquisition, construction and financing set forth in Section 2 herein is $150,000,000, and the principal amount of the bonds proposed to be issued is $150,000,000. In determining the amount of bonds to be issued, this City Council has included all costs and expenses authorized by Section 54410 of the Government Code. Section 4. The maximum rate of interest to be paid on the bonds shall not exceed eight percent (8 per annum, payable annually or semiannually, the actual rate or rates of interest to be determined at or prior to the time of the sale or sales of the bonds. Section 5. If the proposition for the issuance of the bonds so submitted receives the assent of a majority of the voters voting on the proposition, electric revenue bonds as provided herein (in not exceeding the principal amount stated in such proposition) shall be issued and sold for the purpose set forth herein. The bonds are to be revenue bonds payable exclusively from the revenues of the enterprise, shall not constitute an indebtedness or general obligation of the City of Anaheim, and are not to be secured by the taxing power of the City. Section 6. The enterprise referred to in Section 5 herein is defined to be the entire electric system of the City of Anaheim, including all improvements and extensions later constructed or acquired. 2. Section 7. The proposition to be submitted shall be substantially as follows: ELECTRIC REVENUE BOND PROPOSITION: In order to provide more economical electrical service, shall the City of Anaheim be authorized to finance the construction and acquisition of facilities, property and rights related to the generation, transmission and distribution of electrical energy by issuing revenue bonds, not payable from property taxes, in an amount not to exceed 150 Million Dollars? Section 8. The special election hereby called for the date hereinbefore specified is hereby ordered consolidated with the school district governing board elections to be held on said date in the following school districts: North Orange County Community College District Rancho Santiago Community College District Anaheim Union High School District Fullerton Union High School District Anaheim City School District Placentia Unified School District Centralia School District Magnolia School District Savanna School District Orange Unified School District Buena Park School District Fullerton School District Carden Grove Unified School District Within the respective portions of the City of Anaheim, lying within each of said school districts, the precincts, polling places and officers for election for 3. said special election shall be the same as those provided for said school district elections. The manner of holding said special election, including the canvass of the returns thereof, shall be the manner prescribed by or pursuant to law for said school district elections, and the manner of voting upon the proposition hereinabove set forth shall be the manner prescribed by or pursuant to law for voting upon measures at said school district elections. In all other particulars, the election hereby called shall be held and the votes canvassed pursuant to law for general municipal elections held in the City of Anaheim. Section 9. The Superintendent of Schools of Orange County is hereby requested to order that said special election and said school district elections be consolidated in the manner hereinabove set forth and in accordance with law, and the Registrar of Voters of Orange County is hereby authorized and requested to canvass the returns of said special election in the manner provided by law and to certify the results of said canvass to this City Council. Section 10. The City Clerk shall certify to the adoption of this resolution and shall cause it to be published once a day for at least seven days in the Anaheim Bulletin, a newspaper of general circulation published in the City of Anaheim. No other notice of such election need be given. 4. Section 11. The City Clerk shall file certified copies of this resolution with the Superintendent of Schools of Orange County and with the Registrar of Voters of said County.
