A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DENYING REQUEST FOR ABANDONMENT 74 -7A
AND APPROVING THE TERMS AND CONDITIONS OF AN
ENCROACHMENT PERMIT WITH CARTER L. AND VIRGINIA
HORNEY. (74 -7AE)
WHEREAS, Carter L. and Virginia Horney have submitted
a request to abandon a portion of an existing public utility
easement located within Lot 5, Tract 1353, west of Sunkist Way,
north of Romneya Drive, for the purpose of installing a
swimming pool; and
WHEREAS, subject request has been reviewed by all
departments of the City of Anaheim and affected outside agencies;
and
WHEREAS, the City Council does find that it would not
be in the best interests of the City to proceed with said
abandonment and hereby denies said request; and
WHEREAS, the City Council of the City of Anaheim does
grant to Licensees a License to Encroach upon easement for the
purpose of installing a swimming pool; and
WHEREAS, the proposed encroachment for such installa-
tion across a portion of the easement of the City will not
interfere with the present use of the easement of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Carter L. and Virginia
Horney, be and the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said License
Agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 19th day of November, 1974.
