A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING EASEMENT FOR PUBLIC STREET
PURPOSES AND AUTHORIZING PAYMENT THEREFOR
(RIGHT -OF -WAY NO. 1676).
WHEREAS, it has become necessary to acquire
easements for public street purposes upon, under and across
certain land in the City of Anaheim owned by The Atchison,
Topeka and Santa Fe Railway Company; and
WHEREAS, The Atchison, Topeka and Santa Fe Railway
Company has tendered to the City of Anaheim a fully executed
deed of easement conveying an easement for public street
purposes across railroad right -of -way at Tustin Avenue,
crossing No. 2N -0.8; and
WHEREAS, said deed is necessary for the construction
of street improvements for Tustin Avenue at The Atchison,
Topeka and Santa Fe crossing.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that it accept, and it does hereby
accept that certain deed of easement from The Atchison, Topeka
and Santa Fe Railway Company covering said easement.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized and directed to execute
acceptance of said deed and to forward a certified copy of
this resolution to The Atchison, Topeka and Santa Fe Railway
Company.
BE IT FURTHER RESOLVED that the Finance Director is
authorized and directed to pay to The Atchison, Topeka and
Santa Fe Railway Company the sum of $150.00 as consideration
for said deed of easement.
AND BE IT FURTHER RESOLVED that the City Clerk be,
and she is hereby authorized and directed to cause said deed
of easement to be recorded in the Office of the County Recorder.
THE FOREGOING RESOLUTION is approved and signed by
me this 29th day of October 1974.
