1974-524ATTY -18 -C (Page 1 of 1 page) RESOLUTION NO. 74R -524 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 74 -A5 -14 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 39th day of p�3tohPr 19 and and continued to the day of 99 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 74 75 -1 That certain parcel of land being a portion of Lots 1, 6, 7 and 8 in Tract No. 117, as shown on a map thereof recorded in Book 11, page 15, Miscellaneous Maps, records of Orange County, California described as follows: Beginning at a point in Mohler Drive Annexation boundary line to the City of Anaheim, said point of Beginning being in the southeasterly corner of the Mohler Drive No. 2 Annexation to the City of Anaheim; thence leaving said Mohler Drive Annexation boundary line and following along the easterly annexation boundary line of said Mohler Drive No. 2 Annexation, the following courses and distances: N 12° 00' 00" E, 114.00 feet; N 49 00' 00" W, 90.00 feet; N 12 00' 00" W, 55.00 feet; N 15 00' 00" E, 176.00 feet; N 30 00' 00" E, 66.00 feet; N 57° 11' 10" E, 140.71 feet to an intersection with a line bearing S 60° 39' 30" W distant 23.09 feet from the most easterly cor- ner of Lot 8 in said Tract No. 117; thence leaving said Mohler Drive No. 2 Annexation boundary line N 60° 39' 30" E, 23.09 feet to the most easterly corner of said Lot 8; thence N 64° 42' 30" E, 236.20 feet to the most northerly corner of Lot 7 in said Tract No. 117; thence following along the easterly line of said Lot 7 and a portion of the easterly line of Lot 6 in said Tract No. 117 S 19 32' 30" E, 386.75 feet; S 45 53' 30" E, 178.48 feet; S 72 16' 10" E, 62.37 feet; S 28 27' E, 150.45 feet to an intersection with the south line of said Tract No. 117, said point of intersection being distant 104.39 feet east of the southwest corner of said Lot 1, said point of inter- section also being a point in the existing City limit line of the City of Anaheim as established by the aforementioned Mohler Drive Annexation; thence W, 763.47 feet along a portion of the south line said Tract No. 117, also being a portion of said Mohler Drive Annexation boundary line to the point of begin- ning. be excluded from County of Orange 100 -E4- 20,000, SMALL ESTATES, DISTRICT and incorporated in City of Anaheim R -H 22,000, RESI- DENTIAL SINGLE FAMILY HILLSIDE, ZONE subject to the following conditions: 1. That a preliminary title report shall be furnished prior to the adoption of the ordinance rezoning the property, showing, legal vesting of title, legal description, and containing a map of the property. 2. That dedication shall be made to the City of Anaheim of all streets within the area, according to the Circulation Element of General Plan, Highway Rights -of -Way, prior to the adoption of the ordinance rezoning the property. 3. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work shall be complied with as required by the City Engineer and in accordance with stand- ard plans and specifications on file in the office of the City En- gineer, at the time the property is developed. -2- 4. That the owners of subject property shall install street lighting on all streets within the area as required by the Director of Public Utilities at the time the property is developed. 5. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the re- quirements of the Director of Public Utilities. 6. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. If, in the preparation of the site, sufficient grading is required to necessitate a grad- ing permit, no work on grading will be permitted between October 15th and April 15th unless all required off -site drainage facili- ties have been installed and are operative. Positive assurance shall be provided the City that such drainage facilities will be completed prior to October 15th. Necessary right -of -way for off cite drainage facilities shall be dedicated to the City, or the City Council shall have initiated condemnation proceedings there- for (the costs of which shall be borne by the developer) prior to the commencement of grading operations. The required drainage facilities shall be of a size and type sufficient to carry runoff waters originating from higher properties through said property to ultimate disposal as approved by the City Engineer. Said drain- age facilities shall be the first item of construction and shall be completed and be functional throughout the tract and from the downstream boundary of the property to the ultimate point of dis- posal prior to the issuance of any final building inspections or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 7. That ordinances reclassifying the property shall be adop- ted as each parcel is ready to comply with conditions pertaining to such parcel provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels ap- proved by the City Council for a lot split. 8. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire De- partment prior to commencement of structural framing. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Munici- pal Code to accomplish the objects herein found and determined to be necessary and proper.
