A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT WITH PACESETTER HOMES, INC.,
PERTAINING TO REIMBURSEMENT FOR A PRIMARY
DISTRIBUTION MAIN AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAID AGREEMENT
(TRACT 7417).
WHEREAS, the City of Anaheim has provided in
Rule 15 of its Water Rates, Rules and Regulations that Primary
Distribution mains which supply water to all areas of the
system shall be paid for by assessment of acreage fees; and
WHEREAS, said Rule 15 further provides that
developer's portion of the cost shall be reimbursed to him
without interest if, and when, future property within the
refund area is developed and fees are collected; and
WHEREAS, an agreement has been prepared, the terms
and conditions of which are acceptable to the City of Anaheim;
and
WHEREAS, it is in the best interest of the City to
enter into said agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of an
agreement with Pacesetter Homes, Inc., be, and the same are
hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute said agreement on behalf of
the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 24th day of June 1975.
