1975-310RESOLUTION NO. 75R -310 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2704. WHEREAS, after a request for variance by Robert S. Beasley, owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2704 was granted, covering the following described property: The West 82 1/2 feet of the East 247 1/2 feet of the Northwest Quarter of the Northwest Quarter of the Northeast quarter of Section 23, Township 4 South, Range 11 West, in the City of Anaheim, S.B.B. M. EXCEPTING THEREFROM the North 396 feet. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted permitting an 8 -unit apartment complex on the aforedescribed property with a waiver of the following section of the Anaheim Municipal Code: SECTION 18.32.062.012 Maximum building height within 150 feet of agricultural zone. (1 story permitted; 2 stories proposed.) That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the completion of Reclassification No. 74- 75 -33, now pending. 2. That subject property shall be developed precisely in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3; pro- vided, however, that the interior walls of the proposed carports shall be stuccoed, that enclosed storage cabinets -1- shall be provided along the rear wall of each carport, and that adequate bumper guards shall be provided to protect the interior walls of the proposed carports from damage. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein. THE FOREGOING RESOLUTION is approved and signed b me this 24th day of June 1975.
