WH REAS, after a reauest for variance by Anaheim Hills, Inc. /Texaco Ventures, Inc., owners, was received, a public hear- ing before the Planning Commission of the Citv of Anaheim was held upon due and proper notice as a result of which Variance No. 2566 was granted covering the followina described property: All that certain land situated in the State of California, Rancho Santiago de Santa Ana partially in the City of Anaheim and partially in the County of Orange, described as follows: That portion of the land described in the deed to Anaheim Hills, Inc., a California corporation, recorded July 29, 1971, as Instrument No. 24376, in Book 9738, Paae 562 of Official Records, in the office of the County Recorder of said County, described as follows: Proposed Tract No. 2520, being a Subdivision of the following: Beainnina at a >>oint in the Northwesterly line o. that certain land allotted. to Benjamin and Thomas Flint and Llewellyn. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code de- prives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted permitting an 18 -lot subdivision on the aforedescribed property with a waiver of the following section of the Anaheim Municipal Code: -2-- ATTEST: SECTION 18.23.065.010 That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification No. 73- 74 -28, now pending. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to com- ply with the Anaheim Municipal Code and regulations and the condi- tions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and sign d by me this 24th day of June, 1975.
