1975-307ATTY 18 -C (Page 1 of 1 page) RESOLUTION NO. 75R -307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TIIAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in reclassification Pro- ceedings No. 73 -74 -28 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 24th day of June 19 75, and continued to the day of 19 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 73 -74 -28 All that certain land situated in the State of California, Rancho Santiago de Santa Ana partially in the City of Anaheim and partially in the County of Orange, described as follows; That portion of the land described in the deed to Anaheim Hills, Inc., a California corporation, recorded July 28, 1971, as Instrument No. 24876, in Book 9738, Page 562 of Official Records, in the office of the County Recorder of said County, described as follows: Proposed Tract No. 8520, being a Subdivision of the following: Beginning at a point in the Northwesterly line of that certain land allotted to Benjamin and Thomas Flint and Llewellyn Bixby in the Partition of the Rancho San de Santa Ana, distant thereon North 35 50' 38" East, 3341.66 feet from the Northeast corner of the land described in the deed to Santiago Farmers Association, recorded in Book 98, Page 544 of Deeds, in the office of the County Recorder of Los Angeles County, California; thence leaving said Northwesterly line North 54' 09' 22" West, 1534.53 feet to the true point of beginning of the land herein described, said true point of beginning being the Southeasterly terminus of a non tangent curve concave Northeasterly and having a radius of 500.0 feet, a radial line of said curve bears South 64 47' 16" West, through said point; thence North-Fly along said curve through a central angle of 25 38' 50" an arc dis -Once of 223.81 feet; thence tangent North 00 26' 06" East, 391.42 feet to a tangent curve concave Southwesterly and having a radius of 500.00 feet; thence Northwesterly a4ong said curve through a central angle of 28 39' 9 an arc distance of 250.09 feet; thence North 75 21' 42" East, 414.61 feet to a point in the Southwesterly line of Tract No. 8075 as recorded in Book 354, Pages 4 through 10 inclusive of Miscellaneous Maps, records of Orange County; thence along the boundary of said Tract No. 8075 the following courses South 31 50' 33" East, 30.87 iSeet; South 75 03' 57" East, 77.62 fe�t; North 11 18' 36" East, 331.44 feet; North 86 09' 07" East, 389.47 feet; thence leaving the boundary of said Tract No. 8075 gouth 09 52' 23" East, 80.83 feet; thence North 81 08' 11" East, 185.00 feet; thence South 33 18' 12" East, 290.00 feet; thence South 08 07' 00" East, 130.00 feet; thence South 81 53' 00" West, 112.00 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 375.00 feet; thence Southwesterly along said curve through a central angle of 26 48' 00" an arc distance of 175.41 feet; thence tangent to said curve South 55 05' 00" West, 335.48 feet to the beginning of a tangent curve concave Easterly and having a radius -2- of 225.00 feet; thence Southerly along said curve through a central angle of 34 29' 00" an arc distance of 331.77 feet; thence tangent to said curve South 29 24' 00" East, 45.51 feet to the beginning of a tangent curve concave Northwesterly and having a radius of 275.00 feet; thence Southwesterly along said curve through a central angle of 103 07' 03" an arc distance of 494.93 feet; thence tangent to said curve South 73 43' 03" West, 303.34 feet to the beginning of a tan- gent curve concave Southeasterly and having a radius of 18.00 feet; thence Southerly along said curve through a central angle of 93 38' 28" an arc distance of 29.42 feet; thence radial to said curve South 70 04' 35" West, 54.00 feet to the beginning of a non tangent curve concave Southwesterly and having a radius of 473.00 feet, a radial line through said beginning of curve bears North 70 04' 35" East; thence Northwesterly along said curve throughacentral angle of 05 17' 19" an arc distance o; 43.66 feet; thence tangent to said curve North 25 12' 44" West 270.00 feet; thence North 64 47' 16" East, 27.00 feet along a radial line to the true point of beginning. be excluded from "RS- A- 43,000" RESIDENTIAL /AGRICULTURAL ZONE and incorporated in "RS -HS- 22,000" RESIDENTIAL, SINGLE FAMILY HILLSIDE ZONE subject to the following conditions: 1. That a final tract map of subject property shall be sub- mitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 2. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 3. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire De- partment prior to commencement of structural framing. 4. That subject property shall be served by underground util- ities. 5. That these reclassification proceedings are granted sub- ject to completion of annexation of subject property to the City of Anaheim. 6. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1 and 5, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 7. That Condition No. 4, above mentioned, shall be complied with prior to final building and zoning inspections. -3- BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Munici- pal Code to accomplish the objects herein found and determined to be necessary and proper.
