1975-167WHEREAS, SB 1 would amend the Brown Act to
prohibit the legislative body of a local agency from
holding an executive session to consider the appointment,
employment or dismissal of a public officer; or to hear
complaints or charges brought against a public officer by
another person; and
WHEREAS, SB 175 would amend the Brown Act to
provide that a meeting of less than a quorum of the govern-
ing board of a local agency is subject to the provision
of the Brown Act; and
WHEREAS, SB 175 purports to substantially
interfere with and restrict the orderly flow of business
on local agency agendas; and
WHEREAS, SB 175 would prohibit the legislative
body of a local agency from holding an executive session to
consider the appointment or removal of a member of a
legislative body, board, commission or committee.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the City of Anaheim is opposed
to Senate Bill 1 and Senate Bill 175 for the reasons that:
(1) The public interest is not served by removing the
flexibility of the legislative body of a local, agency to
consider appointments, removal or employment of public
officers, boards and commissions in executive sF,,ssion.
(2) The structuring of local agency agendas should be left
to the discretion of local agencies so that the public
business may be accomplished without artificial delay.
THE FOREGOING RESOLUTION is approved and signed by
