1975-064RESOLUTION NO. 75R -64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THAT A PORTION OF A CITY PUBLIC UTILITY EASEMENT DESCRIBED HEREIN NOT BE ABANDONED. WHEREAS, the City Council of the City of Anaheim did, on the 14th day of January, 1975, pass its Resolution No.75R -18 entitled "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE CERTAIN REAL PROPERTY AND FIXING A DATE FOR HEARING THEREON," whereby it declared its intention to vacate and abandon a portion of an existing public utility easement located at the west side of Dwyer Drive, south of Westmont, in the City of Anaheim, and more particularly described hereinafter; and WHEREAS, the City Council did by said resolution fix the 4th day of February, 1975, at 2 :30 o'clock P.M. in the Council Chamber in the City Hall of the City of Anaheim as a time and place for a public hearing on the matter of such vacation and abandonment, for all persons interested to come and hear and show cause if they had any objection as to why such portion of public utility easement should not be vacated or abandoned and closed to public use; and WHEREAS, said City Council did, on the 4th day of February at 2:30 o'clock P.M. conduct a public hearing on the matter of whether said public utility easement should be vacated, abandoned and closed to public use; and the said hearing did hear said evidence thereon; and WHEREAS, the City Council finds, from the evidence submitted, that said public utility easement described in the resolution of intent, and more particularly hereinafter described, is necessary for public utility purposes; and that an order vacating and abandoning such public utility easement should not be made by the City Council. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that: 1. It finds, from all the evidence submitted, that said public utility easement described in said resolution is necessary for present or prospective public purposes; 2. It does hereby order that said portion of a public utility easement located on the west side of Dwyer Drive, south of Westmont, not be vacated, abandoned and closed to public use; and 3. Said portion of said public utility easement described in Resolution No. 75R -18 is situated in the City of Anaheim and more particularly described as follows: -1- 74-9A ATTEST: That certain 5 -foot wide public utility easement located in the City of Anaheim, County of Orange, State of California, to be abandoned, described as follows: The easterly 5 feet of Lot 5 in Tract No. 1456, as shown on a map recorded in Book 48, page 20, Miscellaneous Maps, records of said Orange County, said 5 -foot easement also shown as the southwesterly 5 feet of Parcel H, the-northwesterly 5 feet of Parcel I and the northeasterly and northwesterly 5 feet of Parcel J, as shown on -a map of resurvey of a portion of said Tract No. 1456, filed in Book 32, page 5, Record of Surveys, in the office of the County Recorder of said Orange County.
