1975-020RESOLUTION NO. 75R 20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE CERTAIN REAL PROPERTY AND FIXING A DATE FOR HEARING THEREON. WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5 of the Government Code, in connection with a request for vacation and abandonment of a portion of an existing public utility easement located at the east side of Brookhurst Street, north of Crescent Avenue, in the City of Anaheim, and more fully hereinafter described. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it hereby declares its intention to vacate, abandon and close to public use that portion of an existing public utility easement located at the east side of Brookhurst Street, north of Crescent Avenue, in the City of Anaheim, for public utility purposes as it may relate to the following described property, to wit: That portion of an existing public utility easement located in the City of Anaheim, County of Orange, State of California, lying within a portion of the Northwest quarter of Section 8, Township 4 South, Range 10 West, S.B.B. M., described in the deed recorded in Book 8552, pages 71 and 72, Official Records of said Orange County, to be abandoned. The easterly 156 feet of the westerly 313.62 feet and the easterly 46 feet of the westerly 382.62 feet of the easement described in the above mentioned deed. All measurements for the purpose of this description are taken from the centerline of Brook hurst Street, as shown on the map attached hereto and made a part hereof. Reserving therefrom over and along the area above described to be abandoned, an easement for overhead power lines, overhang and cross arm purposes. For the purpose of this abandonment, the proposed building will not exceed the height of 15 feet 6 inches as measured perpendicularly from the natural level of the ground. and it elects to proceed under the provisions of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5, of the Government Code. BE IT FURTHER RESOLVED that a time and place for hearing all persons interested in or objecting to the proposed vacation and abandonment has been fixed on the 4th day of February 1975, at 2:30 o'clock P.M. in the Council Chamber in the City Hall in the City of Anaheim. 74 -10EA AND BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and shall cause the same to be published in a manner prescribed by law in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City of Anaheim.
