1976-141RESOLUTION NO. 76R-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANIAHEI11 GRANTING, IN PART, VARIANCE NO. 2783. WHEREAS, after a request for variance by D and T Leasing, owners, was received, a public hearing before the Plan- ning Corranission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2783 was granted, in part, covering the following described property in the City of Anaheim, County of Orange, State of California: East 88 -feet of Lot 3 in Tract 162, Home Croft Tract, as per map thereof recorded in Book 12, page 6 of Kiscellaneous Maps, records of Orange County. AP #128-341-39 CODE 01-030 The West 132 feet of Lot 3, Tract No. 162, in the City of Anaheim, as per map recorded in Book 12, Page 6 of Miscellaneous Maps, in the office of the County Recorder of said Orange County. EXCEPTING therefrom the Easterly 106 feet of the Northerly 100 feet of the Westerly 132 feet of Lot 3 of Tract 162, in the City of Anaheim, as per map recorded in Volume 9, Page 54 of Kiscel- laneous Maps, records of said County. WHEREAS, thereafter, within the time prescribed by law, an interested party or the Citv Council, on its own notion, caused the review of said Planning Corartission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following -findings: 1. That there are special circusistances applicable to the property including size, shape, topography, location or surround- ings which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the prop- erty of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of t the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted to expand an existing manufacturing facility with a waiver of the following section of -the Anaheim Municipal Code. SECTION 18.61.063.011 - klinimurr, required landscaping (10 feet required; 1.5 -feet proposed) That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification '_­-.�o. 75-76-25, now pending. CKC 2. That subject property shall be developed substantially in accordance with the plans and specificationsonfile with the City of Anaheim marked Exhibit Nos. 1 and 2; provided, however, that precise landscaping plans shall be submitted for Planning Commission approval prior to the issuance of a building perrai'4- -- said plans to show ten (10) feet of landscaping adjacent to the front of the buildings, as stipulated to by the petitioner; and, further, that the number and location of the proposed driveway accesses to Ball Road and the traffic circulation Dattern shall be submitted to the Traffic Engineer for approval, as stipulated to by the petitioner. BE IT FURTHER PEESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION this 30th day of March, 1976.
