97-181RESOLUTION NO. 97R -181 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 1731 AS SET FORTH IN RESOLUTION NO. PC77 -157 AS AMENDED BY RESOLUTION NO. PC96 -72. WHEREAS, the Planning Commission of the City of Anaheim heretofore adopted Resolution No. PC77 -157 approving Conditional Use Permit No. 1731, subject to certain conditions specified therein; and WHEREAS, said conditions of approval of Conditional Use Permit No. 1731 were heretofore amended by the Planning Commission by its Resolution No. PC96 -72; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the Planning Commission heretofore adopted its Resolution No. PC97 -111 further amending said conditions of approval which decision was heretofore appealed to the City Council in the manner provided by law; and WHEREAS, the City Council held a duly noticed public hearing on September 23, 1997, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the City Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said conditional use permit. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 1731 be, and the same are hereby, amended by the amendment of Conditions Nos. 5,6 and 17 as set forth in Resolution No. PC77 -157, as amended by Resolution No. PC96 -72, to read as follows: That within a period of sixty (60) days from the date of this resolution, a Lot Line Adjustment Plat to combine the two (2) existing lots shall be submitted to the Subdivision Section for approval by the City Engineer and recordation in the Office of the Orange County Recorder. 6. That within a period of sixty (60) days from the date of this resolution, a parking plan shall be submitted to the Traffic and Transportation Manager for review and approval. 5 17. That subject use permit shall expire five (5) years from the date of this resolution, on September 23, 2002." BE IT FURTHER RESOLVED that, except as expressly amended herein, Conditional Use Permit No. 1731 as approved by Resolution No. PC77 -157, and as amended by Resolution No. PC96 -72, shall remain in full force and effect. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 23rd day of September, 1997.
