1976-119P,EESOLUTION NO. 761R-119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AINTAHIEIM GRANTING, IN PART, VARIANCE NO. 2777. WHEREAS, after a request for variance by Marie A. Androus, Owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2777 was granted, in part, covering the follow- ing described property: Those portions of the Northeast quarter of the Northwest quarter of Section 13, Township 4 South, Range 11 West, in the City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in book 51, page 11, His- cellaneous Maps, records of said Orange County, described as follows: PARCEL 1: The West 272.62 feet of the East 1,000.53 feet of the North 226 feet of the Northeast quarter of the Northwest quarter of said Section 13. EXCEPTING THEREFROM the North 66 feet. ALSO EXCEPTING THEREFROM that portion lying within the West 60 feet of the East 894.22 feet of said Northeast quarter of the Northwest quarter. PARCEL 2: An easement for road and utility purposes over the West 60 feet of the East 894.22 feet of the North 226 feet of the Northeast quarter of the Northwest quarter of said Section 13. EXCEPTING THEREFROM the North 66 feet. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by -other property under identical zoning classification in the vicinity. NOW, THERE -FORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby, granted permitting a 16 -unit apartment complex with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.01.130 - Requirement that all lots abut a public street. (Two lots to abut a private street) SECTION 18.04.045.014 - Minlirtum,front setback. (35 feet required; 10 feet proposed) ThatsaidVariance be granted: _subject to.the ,fol lowing conditions: 1. That this Variance isgranted subject to thel,completion of Reciassification-No.,75-76-1 1 8. now pending. 2. That subject property shall be developed substantially in accordance with 'plans and specifications on file with the City of Anaheim marked-EmlUbit Nos. 1 (Revision No. 1), 2, 3, 4, 5 and 6. BE IT FURTHER RESOLVED that, the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, successors or,assignsto comply with the Anaheim Municipal Code and regulations and the conditions herein. Said -variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FO GOING 1.
