1976-095RESOLUTION O. 76R-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTINC, IN FORT, VARIANCE N 2 O. 768. WHEREAS, after a request for variance by William D. Ehrle, owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2768 was granted, in part, covering the following described property: All that certain land situated in the State of Cali- fornia, County of Orange, City of Anaheim, described as follows: Lot 73 of Tract No. 2350, as shown on a Map recorded in book 69, pages 45, 46 and 47 of Miscellaneous lops, records of Orange County, California. WHEREAS, thereafter, within the time prescribed by Mg, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the sane is hereby, granted, in part, to permit an office in "RS -7200'' zoned property with a two (2) year waiver of the following section of the Anaheim Municipal Code: .SECTIO M 13.26.020 - Permitted uses. (Office not permitted in the "RS -7200" Zone) That said Variance be granted, in part, subject to the following conditions: 1. That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the center- line of the street along State College Boulevard including a 15 - foot radius property line return for street widening purposes. 2. That the existing structure shall be brought up to the minimum standards of the City of Anaheim including the Uniforni. Building, Pluabing, Electrical, Housing, Mechanical and Fire Codes, as adopted by the City of Anahei_-.-i. 3.
