1976-069NO. 76R-69 A PESOLU-10ION. OF T CITY COUNCIL OF THE CITY OF ANAHEIM GPANTING VARIA NO. 2771. WHEREAS, after a request for variance by 1',lark D. Leff, owner, was received, a Public hearing before the Planning Co-immiis- sion of the City of Anaheim was held upon cue and proper notice, a result of which Variance No. 2771 was granted covering the fol- lowing described property: That portion of Tract No. 613, in the City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 19, Page 19, Miscellaneous flaps, records of said Orange County, which lies east and south of a line described as follow�s: Beginning at a point in the north line of said Tract No. 613, (said north line being tl--.e center- line of Placentia-Yorba Boulevard as shown on said map) distant thereon North 870 191 West 685.30 feet from the northeast corner of said 71 Tract No. 613, and running lCfence South 70 151 East parallel with the easterly line of said Tract No. 613, 278.34 feet; t2hence South 750 201 West to a point in -the westerly line of said Tract No. 613 which is distant 570.00 -feet South 18* 11..1 West from the niost northwest corner of said, Tract No. 6113. Excepting that -portion which lies west of a line whici.a. con-nences at a point in the south line of said Tract No. 613, distant thereon 827.04 feet North 730 121 East f-ro7.,.n the southwest corner of said Tract No. 613, and anis thence North 70 151 West 1208.11 feet to the 14 ne first above des- cribed. Also except-ing the southerly 20 feet as conveyed to the County of Orange for road purposes by deed recorded February 24, 1926 in Book 626 Page 387, Deeds. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council on its own Y.-totion caused the review of said Planninq Cort.,amission action at a pifblic hearing noticed and held as prescribed by law and, as a result thereof, the Citv Council does herebv make the following findings: 1. That t1 ere are special circumstances applicable to the Property including size, shape, topography, 'Location or surround- ings, ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classificat4 on in tLe v-cinitv. J_ -1- NOW,TRIER FORE, BE IT IFW SOLVED by the 'C*ity Council of the City of 71naheim that a conditional zoning variance be, and -the same is hereby, granted permi-t-ting a 117 -Lot "11,S-5000" sub- division with a waiver of the following section of -the Anaheim, MuniciDal Code: SECTION 18.27.065.010 - Requiremenit that single -family structures rear on arterial high- ways. (one lot to side on Orange- thorpe Avenue) That said Variance be granted subject to the -following conditions: 1. That this Variance is granted subject to the completion of Peclassification No. 75-76-16, now pending. 2. That subject property shall be developed substan-tialiv in accordance'wjitlh plans and specifications on I file with the City o-1-2 Anaheim marked Exhibit No. 1;. provided, however, that Lot 'ATo. 39, as shown on E,:�hibit No. 1, shall have a miniriyum building set- back of forty (40) feet adjacent, to Orangethorpe Avenue, per City Council Policy 11:416. 538, 'unless the City Counrcil'grants relief from said Policy and permits a 26 -foot setback f'Or said lot; and that a structural wall, as defined in the Uniform Building Code, shall be constructed on top of the proposed berm along the north- er -1v property line adjacent to Crowther Avenue and the railroad tracks, as a sound attenuation -measure complying with Council Policy No. 542, as stipulated to by the petitioner. BE IT FURTHER RESOLVED that the City 'Count' il hereby re- serves the right to revoke such variance permit for good cause or J_ailure of said owner, his heirs, successors or assigns to cornply with the Anaheim Municipal Code and regulations and the conditions herein.
