1976-068RESOLUTION NO. 76Ft-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TnAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in reclassification Pro- ceedings No. -5-76-16 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 17th day of Februar, y, , 19 76, and continued to the day of 19 as the time, and the City CouncIT-CSambers in the y Hallofthe City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit; 75-76-16 ATTY-18-C (Page 1 of 1 page) That portion. of Tract No. 613, in the City of .X - Anaheim, County of Orange, State of California, as shown on a mai thereof recorded in Book 10, Page 19, Miscellaneous Maps, records of said Orange County, which 1-Jes east and south of a line described as follows: Beginning at a point in the north line of said Tract No. 613, (said north line being the center- line of Placentia-Yorba Boulevard as shown on said map) distant thereon North 870 191 West 685.30 feet from the northeast corner of said Tract lio. 613, and running thence South 70 151 East parallel with Cie easterly line of said Tract No. 613, 278.34 feet--; thence South 750 201 West to a point in the westerly line of said Tract No. 613 which is distant 570.00 feet, South 18* 111 West from the iuost northwest corner of said Tract- No. 613. EXcepting that portion which lies west of a line which7 commences at a Point in the south line of said Tract No. 613, distant thereon 827.04 feet North 730 121 East from the southwest corner of said Tract blo. 613, and runs thence North 70 151 West 1208.11 feet to the line first above des- cribed. Also eXceptina the souther1v 20 feet as conveyed to the Countv of Orange for road purposes by deed recorded February 24, 1926 in Book 626 Page .387, Deeds. be excluded from "CL" COMPIE-RCIAL, LIMITED ZONE and "CH" COINIMRCIAL, HEAVY ZONE and incorporated in "RS -5000" RESIDENTIAL, SINGLE-FAMILY ZONE subject to the following conditions: 1. That all engineering requirermen-L-s of the City of Anaheim, along Crowther Avenue and Kraermer Boulevard including preparation of improvement plans and installation Of all installation improvenents such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required bV the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Crowther Avenue, Kraemer Boulevard and Orangethorpe Avenue shall be installed as required by the Direc- tor of Public Utilities, and in accordance with standard plans and specifications on file in the office of tree Director of Public Uiili-EI_-ies and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with t:he City to guarantee the in- stallation of the above-mentioned requirements. 2. That sidewalks shall be installed along Orangeth-orpe Ave- nue as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 3. That the owner(s) of s =-ject proper-ty shall -pay to the City of Anaheim the sum of sixty cents per front foot along Crowther Avenue, Kraemer Boulevard and Orangethor'De Avenue for tree -planting purposes. 4. That 'Lire hydrants shall be installed and charged as required and determined to be necessary by the Chief o--"- the Fire Department prior to coraiencement of structural framing. 5. That subject Property shall be served by underground utilities. 6. That drainage of- subject property shall be disposed of in a manner satisfacto=i to the City Engineer. 7. T'hat the owner(s) of sub-Ject D-ronerty shall- pay to the City of Anaheim the appropriate park., and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the tia e the building per.-iiiii: is issued. 8. That a final tract map of subject property shall be sub- mitted to and approved by the City, Council and then be recorded in the office of tie Oranae_Count-,,;, 'Recorder. 9. That completion of these reclassification pr6ceedincrs is contingent upon the granting of Variance No. 27,71. 10. Prior to the introduction of an ordinance rezoninq s,-,b--- ject- -property, Condition Nos. 1 and 3, above-mentioned, shall be completed. The provisions or rights granted by;; this resolution shall become null and void by actlon of the City Council unless said conditions are complied wit. within one year froimi. the date hereof, or such further tinie as the C4L --V Council may grant. 11. That Condition "los. 2, 5 and G, above-mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim, Municipal Code to accomplish the objects herein found acid deter- rdined to be necessary and proper.
