A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A MUTUAL TERMINATION
AGREEMENT OF A TEMPORARY PRIVATE CROSSING
EASEMENT WITH THE ATCHISON, TOPEKA AND SANTA
FE RAILWAY COMPANY AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE SAME.
WHEREAS, on the 25th day of January, 1968, the
City of Anaheim and The Atchison, Topeka and Santa Fe
Railway Company entered into a temporary agreement to
permit a street to cross the Railway at a location
designated therein; and
WHEREAS, subsequent thereto the parties have
arranged for a permanent easement underpass of said Railway;
and
WHEREAS, as a result of said underpass, said
temporary private street crossing is unnecessary; and
WHEREAS, the parties to said private street
crossing desire to mutually terminate said temporary street
railway crossing.
NOW, THEREFORE, BE IT RESOLVED by the City Council
that the mutual termination agreement terminating the tem-
porary street railway crossing dated January 25,,1968, between
the City of Anaheim and The Atchison, Topeka and Santa Fe
Railway Company be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
