1976-026RESOLUTION NO. 76R-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY - OF ANAHEIM GRANTING VARIANCE NO. 2757. WHEREAS, after a request for variance by John P. and Maureen M. Younkin, owners, was received, a public hearing be- fore the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 2757 was granted covering the following described property: All that certain land situated in the State of Cali- fornia, County of Orange, City of Anaheim described as follows: That portion of Lots 3 and 4 in Block 23 of Golden State Tract, as shown on a map thereof recorded in book 4, pages 66 and 67 of Miscellaneous Maps, rec- ords of said Orange County, described as follows: Commencing at the intersection of the Southwesterly line of said Lot 3 with a line that is parallel with and distant Westerly 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence North 70 261 30" West along said parallel line a distance of 361.90 feet, said point being the true point of beginning; thence South 820 331 30" West 230.12 feet; thence South 290 191 30" I -lest 132.16 feet to a line that is parallel with and distant Northeasterly 20.00 feet measured at right angles from the Southwesterly line of said Lot 3; thence North 600 401 30" West along said parallel line a distance of 376.31 feet; thence North 7* 261 30" West 325.51 feet to the Southerly line of land described as Parcel 2 in a Deed to the State of California filed February 25, 1954 as Document No. 28719, in the office of the Registrar of Titles in the office of the County Recorder of Orange County, California; thence North 820 331 30" East 610.69 feet along said Southerly line and its Easterly pro- longation to a line that is parallel with and distant Westerly 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence South 70 261 30" East 444.86 feet to the true point of beginning. Excepting therefrom the Westerly 145.00 feet thereof measured along Northerly line of said lots. Also excepting therefrom that Portion of said land lying North and Easterly of the following described line: Commencing at a point on the West line of the East 217.50 feet of said Lot 3 distant along said West line, South 7* 191 35" East, 368.16 feet from the North line of Canal Street 25.00 feet wide as shown on said map; thence Westerly along a non -tangent curve concave Northerly having a radius of 4948.00 feet from a tangent which bears South 860 071 11" West, an arc distance of 336.32 feet to the Northerly line of the land described in deed to Freeway Indus- trial Center, Inc., recorded October 31,, 1963 in book 6786, page 11 of Official Records. -1- WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property Of privileges enjoyed by other property under identical zoning classification in the vicinity. NOW, THEREFORE, BE the City of Anaheim, that a the same is hereby, granted complex with waivers of the Municipal Code: SECTION 18.34.062.012 SECTION 18.34.062.032 IT RESOLVED by the City Council of conditional zoning variance be, and permitting a -108 -u -nit apartment following sections of the Anaheim - Flaximum, Building Height. (one story permitted; two stories proposed) - Minimum Floor Area. (700 square feet required; 484 and 508 square .feet proposed) That said Variance is granted, subject to the following conditions: 1. That this Variance is granted subject -to the completion of Reclassification No. 75-76-15, now pending. 2. That this Variance is granted subject to the termination of Conditional Use Permit No. 1125 on the subject property. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the Citv of Anaheim marked Exhibit Nos. 1, 2, 3, 4 and 5; provided, however, that this Variance is granted for a -108 -unit apartment complex; that site screening shall be provided on the southerly portion of the subject property in conformance with Code requirements, as stipulated t; by the petitioner; that four dwelling units shall be deleted from the proposed development and replaced by additional parking spaces, as stipulated to by the petitioner; and that the easterly drive cut on the southerly portion of subject property shall be aligned with the central drive cut on the north side of Jackson Street, subject to the approval of the City Traffic Engi- neer, as stipulated to by the petitioner.
