1976-025RESOLUTION NO. 76R-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDIINIG AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in reclassification Pro- ceedings No. 75-76-15 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 20th day of January , 19 76 , and continued to the day of 19 , as the —time, and the City Counc-l=ambers in -the City Hallofthe City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property 'hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED the City of Anaheim that Title 18 of the be, and the same is hereby, amended and described property, situated in the City Orange, State of California, to wit: -I- ATTY-18-C (Page 1 of 1 page) by the City Council of Anaheim Municipal Code that the following of Anaheim, County of 75-76-15 All that certain land situated in the State of Cali- fornia, County of orange, City of Anaheim described as follows: That portion of Lots 3 a -rid 4 in Block 23 of Golden State Tract, as shown on a map thereof recorded in book 4, pages 66 and 67 of Miscellaneous Maps, rec- ords of said Orange County, described as follows: Commencing at the intersection of the Southwesterly line of said Lot 3 with a line that is parallel with and distant Westerlv 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence North 70 261 30" West along said parallel line a distance of 361.90 feet, said point being the true point of beginning; thence South 820 331 30" West 230.12 feet; thence South 29* 191 30" West 132.18 feet to a line that is parallel with and distant Northeasterly 20.00 feet measured at right angles from the Southwesterly line of said Lot 3; thence North 600 401 3011 West along said parallel line a distance of 376.31 feet; thence North 70 261 30" West 325.51 feet to the Southerly line of land described as Parcel 2 in a Deed to the State of California filed February 25, 1954 as Document No. 28719, in the office of the Registrar of Titles in the office of the County Recorder of Orange County, California; thence North 82* 331 30" East 610.69 feet along said Southerly line and its Easterly pro- longation to a line that is parallel with and distant Westerly 217.50 feet measured at right angles from the Easterly line of said Lot 3; thence South 70 261 30" East 444.86 feet to the true point of beginning. That the owner(s) of subject property shall pay to the City of Anaheim the sum of sixty cents per front foot along Fron- tera Street and Jackson Avenue for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Pub- lic Works. 5. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to cormencerient of structural framing. 6. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent properties. 7. That subject property shall be served by underground utilities. 8. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 9. In the event that subject property is to be divided for the purpose of sale, lease or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder. 10. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees, as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 11. That appropriate water assessment fees, as determined by the Director of Public Utilities, shall be paid to the City of Anaheim prior to the issuance of a building permit. 12. That the owners(s) of subject Property shall pay to the City of Anaheim a proportionate share of the expense previously incurred by the City of Anaheim for the acquisition of right -o4 - way and street improvements in connection with the improvements to Jackson Avenue, said proportionate share being 24.35% of the total costs and amounting. to $3,331.08 for right-of-way acquisition and $3,947.97 for the street improvements, or a total of $7,279.050 as the proportionate share, as stipulated to by the petitioner, prior to the issuance of a building permit. -3- 13. That the owner(s) of subject property shall pay drain- age reimbursement fees of $444.35 per acre to the City of Anaheim prior to approval of a grading plan or, in the event no grading plan is required, prior to issuance of a building permit. 14. Prior to the introduction of an ordinance rezoning sub- ject property, Condition Nos. 1, 2, 3 and 9, above-mentioned, shall be completed. The provisions or rights granted by this reso- lution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 15. That Condition Nos. 4, 6, 7^and 8, above-mentioned, shall be complied with prior to final building and zoning inspec- tions. BE IT FURTHER RESOLVED that the City. Attorney be, and he is hereby, authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
