1976-008RESOLUTION NO. ZLE-B A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING TftAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN Z014ES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Declassification Pro- ceedings No. =- 6-20 to consider an amendment to Title 18 of the Anaheim MunicipalCoderelating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 6th day of January , 1976, , and continued to the day of 1-9— , as the time, and the City CouncIT-C-Sanbers in!theCity Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 75-76-20 ATTY-18-C (Page 1 of 1 page) All that certain land situated in the State of California., County of Orange, City of Anaheim., described as follows: Proposed Tract No. 8905, being a subdivision of the following: That Dortion of the lands allotted to Juan Yorba and Paula Peralta de Dominguez as described in the Final Decree of Partition of the Rancho Santiago de Santa Ana, as per map of partition recorded on September 12, 1868, in Book "Blt,, page'410 of Judgments of the 17th Judicial . District Court, of Los Angeles County, State of California, described as follows: Beginning at the most Northerly corner of Parcel 1, as 'shown on a map filed in book 50, page 43 of Parcel Maps, records of said Orange County; thence along the boundary of said Parcel Map, South 830 25' 15" West 258-59 feet,.South 700 511 57" West 338.29 feet and South 610 10' 37" West 45-00 feet to a point on a non -tangent curve concave Southwesterly with a radius of 600.00 feet said curve being the centerline of Anaheim Hills Road as shown on said Parcel Map and said curve being concentric with that certain curve cited as being concave Westerly with a radius of 555-00 feet to a central angle of 601 05' 18" in the Westerly boundary of Parcel 1 of deed recorded May 16, 1972 in book 10128, page 922 of Official Records of said Orange Countya radial to said point bears North 611 10' 3711 East; thence Northwesterly along said concentric curve a distance of 74.36 feet through a central angle of 70 061 03"; thence parallel and concentric with said Westerly boundary the following courses: tangent to said last mentioned curve North 350 55' 26" West 109.84 feet, Northwesterly along a tangent curve concave Northeasterly having a radius of 595.00 feet a distance of 144.23 feet through a central angle of 130 53' 19" a tangent to said curve North 22' 021 07" West 464.66 feet, Northerly along a tangent curve concave Easterly having a radius of 605-00 feet a distance of 371.42 feet through a central angle of 350 10' 30ft, tangent to said curve North 130 08' 2311 East 171.97 feet, Northerly along a tangent curve concave Westerly having a radius of 621.00 feet a distance of 236-31 feet through a central angle of 210 48, 0911, tangent to said curve North 80 391 4611 West 321.19 feet, and Northerly along a tangent curve concave Easterly having a radius of 763.'00 feet a distance of 43-01 feet through a central angle of 30 13" 4811 to the Westerly prolongation of that certain bearing shown as 'IN 840 30 02" E radial" at the Southwest corner of Parcel 1 as shown on map filed in book 54, page 5 of Parcel Maps, records of said Orange County; thence along said prolonged linee-North 840 34' 02" East 51-00 feet to said Southwest corner; thence along the boundary of said Parcel -2- 1, South 750 451 00" East 209.72 feet to the Northerly terminus of that certain course shown as "N 30 42' 45" W 762.96 feet" on map filed in book 91, page 40 of Records of Surveys, records of said Orange County; thence along the boundary of said Record of Survey, South 30 421 4511 East 762.96 feet; South 29' 38t 1211 East 763-99 feet South 790 471 2911 East 310.42 feet, North 100 131 56" East 100-03 feet, South 790 571 14" East 99.93 feet,, South 101, 17' 18" West 100-56 feet and South 790 571 17" East 100.11 feet to the Northerly boundary of Parcel 2, as shown on a map filed in book 57, pages,6 and 7 of Parcel Maps, records of said Orange County; thence along the boundary of said Parcel Map South 660 331 5611 West 206.57 feet and South 131 44' 57" East 48.13 feet to the point of beginning. be excluded from 'IRS -A-43,000" (SC) (RESIDENTIAL/AGRICULTURAL ZONE) (SCENIC CORRIDOR OVERLAY ZONE) and incorporated in 11RM-41000" (SC) (RESIDENTIAL, MULTIPLE -FAMILY ZONE) (SCENIC CORRIDOR OVERLAY ZONE) subject to thefollowing conditions: 1. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing.- 2. raming.2. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 3. That completion of these reclassification proceedings is contingent upon the granting of Variance No. 2766. BE IT FURTHER -RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of�the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
