1975-628RESOLUTION NO. 75R-628 A RESOLUTION OF THE CITY COUNCIL OF T1 -1E CITY OF ANAHEIM GRANTING VARIANCE -NO. 2739. WHEREAS, after a request for variance by Edward R. Merger, et al., owner, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2739 was granted covering the following described property: That portion of Northeast Ten (10) acres of the North- west quarter of the Southwest quarter of Section 17, Township 4 South, Range 10 West, S. B. B. & M., des- cribed as follows: Beginning at a point on the North line of said South- west quarter, said point being South 89* 531 31" West 240.50 feet from the Northeast corner of said ten acres; thence continuing South 89* 53' 31" West 161.61 feet; thence South 00 061 29" East 310.08 feet; thence South 89* 29' 49" East 119 feet to a curve concave, Southeast- erly, having a radius of 80 feet and a radial line through said point bears North 890 291 49" West; thence Northeasterly along said curve through a central angle of 610 321 05" a distance of 85.92 feet; thence North 0* 061 29" West 242.27 feet to the point of beginning. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be granted to establish four (4) lots with waiver of the following Sections of the Anaheim Municipal Code: -1- SECTION 18.01.130 - Requirement that all lots abut • public street. (Two lots abut • proposed private street) SECTION 18.26.061.020 - Minimum lot width. (70 feet re- quired; 20 feet proposed) SECTION 18.26.065.010 - Requirement that single family residences rear on arterial high- ways. (Two lots proposed to front on an arterial highway) That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the completion of Reclassification,No. 75-76-6. 2. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim and then be recorded in the office of the Orange County Recorder, prior to the conauencement of the activity authorized under this resolution or prior to the time that the building permit is issued. 3. That all private streets shall be developed in accord- ance with the City of Anaheim's standards for private streets. 4. That subject property shall be developed substantially. in accordance with plans and specifications on file with the City of Anaheim marked Exhibit No. 1; provided, however, that all build- ing setbacks adjacent to Orange Avenue shall have a minimum depth of forty (40) feet in accordance with City Council Policy No. 538. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Dlunicipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is this 9th day of December, 1975.
