1975-626RESOLUTION NO. 75R-626 A RESOLUTION OF -THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING, IN PART, CONDITIONAL USE PERMIT NO. 1574. WHEREAS, the City Planning Cormission of the City of Anaheim did receive an application for a conditional use permit from Brigham Young University, owner, to permit a mobile home park on the following described property: All that certain real property situated in the City of Anaheim, County of Orange, State of California, being That portion of the South Hall of Section 5, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a map recorded in Book 51, Page 10 of Miscel- laneous Maps, records of Orange County, California. described as follows: Beginning at the Northeast corner of Tract No. 2197, as shown on a map recorded in Book 62, Pages 46 to 48 inclusive, of Miscellaneous Maps, records of said County, said point of beginning also being a point in the Southerly line of the land described in deed to the State of California, recorded November 23, 1955, in Book 3291, Page 377, of Official Records of said County; thence along said Southerly line, North 890 071 47" East, 660.92 feet to an angle point therein; thence continuing along said Southerly line, North 890 361 31" East, 684.75 feet to the intersection of the Westerly line of land described in deed to Bert A. Lewis, recorded September 28, 1960, in Book 5438, Page 54, of said Official Records; thence North 890 481 00" East, 813.00 feet; thence South 850 251 00" East, 446.37 feet; thence South 00 131 40" East 684.49 feet to a point in a line which is parallel and 34.00 feet Northerly of the Westerly prolongation of the Northerly line of the land described in the deed to Forest Lawn Cemetery Association, recorded November 1, 1962, in Book 6308, Page 625 of said Official Records, thence along said parallel line South 890 461 20" West 604.35 feet to the beginning of a tangent curve con- cave Southeasterly and having a radius of 162.00 feet; thence Southwesterly along said curve through a central angle of 41* 111 11" an arc distance of 116.45 feet to the beginning of a tangent reverse curve concave North- erly and having a radius of 13.00 feet; thence Westerly along said curve through a central angle of 72* 191 26" an arc distance of 16.41 feet to the beginning of a tangent reverse curve concave Southwesterly and having a radius of 232.00 feet; thence Northwesterly along said curve through a central angle of 23* 261 35" an arc distance of 94.92 feet; thence tangent to said curve North 820 321 00" West, 1,013.98 feet to the be- ginning of a tangent curve concave Northeasterly and having a radius of 318.00 feet; thence Northwesterly along said curve through a central angle of 35* 02' 00" mc an arc distance of 194.44 feet; thence tangent to said curve North 470 301 00" West, 495.13 feet to the begin- ning of a tangent curve concave Southwesterly and hav- ing a radius of 282.00 feet; thence Northwesterly along said curve through a central angle 320 221 19" an arc distance of 159.33 feet to the beginning of a tangent compound curve concave Southerly and having a radius of 158.20 feet; thence Westerly along said curve through a central angle of 10* 181 48" an arc distance of 28.48 feet; thence tangent to said curve South 890 481 5311 West, 77.26 feet to the Easterly boundary of said Tract No. 2197; thence along said boundary North 00 211 35" West, 96,90 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a Public hearing at the City Hall in the City of Anaheim upon said application on October 29, 19,75, notices.of which said public hear- ing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC75-219 approving Conditional Use Permit No. 1574; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Plan- ning Commission in approving said conditional use permit and did thereupon fix the 9th day of December, 1975, as the time and the Council Chamber in the City Hall of the City of Anaheim as the Place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anahein, Muni- cipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing, and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consi- deration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the 'Lull development of the proposed use in a manner not detrimental to the particular area nor to the peace, health , safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the Peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, MHEREFOREI, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion approving said conditional use permit be, and the same is hereby, sustained and that Conditional Use Permit No. 1574 be, and the same is hereby, granted, in part, permitting a mobile home park on the property hereinbefore described with waiver of the following sections of the Anaheim Municipal Code: SECTION 18.04.043.101 - Maximum fence height. (6 feet permitted; 8 and 10 feet proposed) SECTION 18.21.063.010 - Mlinimum front setback. (2.5 feet required - 20 feet proposed) The following sections of the Anaheim Municipal Code are waived for one (1) year from this date only: SECTION 18.05.072.021 - Permitted location of tract sign. (Required to be located on vacant property) SECTION 18.05.072.022 - Maximum area of tract sign. (96 square feet permitted; 250 square feet proposed) SECTION 18.05.072.0231 - Maximum height of tract sign. (14 feet permitted; 45 feet proposed) That said conditional use permit is granted subject to the follow- ing conditions: 1. That subject tract sign shall be permitted on a teimpor- ary basis for a period not to exceed one (1) year from the date of construction, and upon request by the petitioner, additional per- iods of six (6) months may be granted by the Planning Conunission and City Council; provided, however, that if the initial sale of all units or lots in the Anaheim Shores Planned Community is com- pleted during any of the permitted time periods, subject tract, sign shall be removed. 2. That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 64 feet in width from the center- line of the street along Coronet Avenue and a strip of land 30 feet in width from the centerline of the street along Iviedical Cen- ter Drive for street widening purposes. 3. That all engineering requirements of the City of Anaheim along Coronet Avenue and 1,41edical Center Drive including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, that -3- street lighting facilities along Coronet Avenue and Medical Center Drive shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities, and that a bond in an amount and form satisfactory to the City of Ana- heim shall be posted with the City to guarantee the installation of the above-mentioned requirements. 4. That the owner(s) of subject property shall pay to the City of Anaheim the sum of sixty (60) cents per front foot along Coronet Avenue and Medical Center Drive for tree planting purposes. 5. That trash storage areas shall be provided in accord- ance with approved plans on file with the Office of the Director of Public Works. 6. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 7. That all lots within this tract shall be served by un- derground utilities. 8. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer; and provided that approval of the activity authorized under this resolution shall not be construed to include approval of grading plans or drainage and, furthermore, that the drainage of the Anaheim Shores develop- ment shall be approved by the City Council prior to the commence- ment of any grading or construction in the Anaheim Shores develop- ment. 9. In the event that subject property is to be divided for the purpose of sale, lease, or financing, a parcel map to record the approved division of subject property shall be submitted to and approved by the City of Anaheim -and then be recorded in the Office of the Orange County Recorder. 10. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate park and recreation in -lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 11. That appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 12. That the traffic signal at the intersection of La Palma Avenue and Romneya Drive shall be installed concurrently with in- stallation of the street, taking ingress and egress from La Palma Avenue in the Anaheim Shores development, and the cost incurred for said installation shall be paid one-half by the petitioner and one-half by the City of Anaheim, as stipulated to by the peti- tioner and concurred with by the City of Anaheim. 13. That no vehicular access shall be permitted between the existing easterly termini of Falmouth and Coronet Avenues and the future easterly extension of said streets until all phases of con- struction of the Anaheim Shores development are completed. mc 14. That subject property shall be developed substantially in accordance with plans and specifications on file with the City. of Anaheim marked Exhibit Nos. 1, 2, 31 4 and 5; and that two additional off-site tract signs are permissible at La Palma Avenue and Euclid Street. 15. That Condition Nos. 2, 3, 4, 8, 9 and 12, above-mentioned, shall be complied with prior to the commencement of the mobile home park activity authorized under this resolution, or prior to the time that the building permit is issued for the mobile home park, or with- in a period of one year from date hereof, whichever occurs first, or such further time as the Planning Commission and/or City Council may grant. 16. That Condition Nos. 5, 7 and 14, above-mentio'ned, shall be complied with prior to final building and zoning inspections. 1-7. That approval --of this -conditional use permit- is made sub- ject to termination of -the requested theme tower approved in Vari- ance<No. 2635, as stipulated --to by the Petitioner. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right- to revoke such Conditional Use Permit for good J_ cause or failure of said owner(s), its successors or assigns to comply with the Anaheim Municipal Code -and regulations and the conditions therein.
