1975-605RESOLUTION NO. 75R-605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE NECESSITY FOR AND DIRECTING THE ACQUISITION BY EMINENT DOMAIN OF REAL PROPERTY FOR ROAD AND PUBLIC UTILITY PURPOSES. (Ricker) WHEREAS, public convenience and necessity require the acquisition of certain real property within the City of Anaheim for road and public utility purposes; and WHEREAS, the City Council does find and determine that public interest and necessity require the acquisition of all that real property herein described by the City of Anaheim for road and public utility purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity re- quire the acquisition of the following described real property, to wit: An easement for road and public utility purposes over, under and across that portion of Parcel "N", as shown on a map of a re -survey of a portion of Tract No. 2490 filed in Book 30, page 18 of Record of Surveys, in the office of the County Recorder of said Orange County, described as follows: Beginning at the centerline intersection of Lincoln Avenue and Sunkist Street; thence Westerly along the centerline of Lincoln Avenue, 70.53 feet_; thence N ll* 07' 24" E, 50.00 feet to a point in the/northerly-right of way.line of said Lincoln Avenue, said point being the beginning of a curve concave northwesterly and hav- ing a radius of 25.00 feet; thence Easterly and North- erly along said curve through a central angle of 1000 57' 0811 an arc distance of 44.01 feet to a point in a line that is parallel with and distant 30.00 feet west- erly of the centerline of said Sunkist Street; thence 5.890 4911 4411 E, 30.00 feet to a point in said center- line; thence: Southerly along said centerline, 87.03 feet to the true point of beginning. Excepting therefrom that portion lying within the exist- ing right of way of Lincoln Avenue and Sunkist Street. BE IT FURTHER RESOLVED that the City Council find, and it does hereby find and determine, that public interest and necessity require the acquisition of said property by the City of Anaheim for the aforesaid purposes, and that the taking of the property hereinabove described is necessary therefor, and that the uses to which it is to be put are uses authorized by law, and the taking of said property is necessary to such uses. AND BE hereby authorize .A of Anaheim, and hereby directed IT FURTHER RESOLVED that the City Council does the acquisition of said property by the City the City Attorney of the City of Anaheim is to institute an action in eminent domain for the acquisition of the title to said property, and to perform and carry out all of the necessary proceedings and steps in- cident to the acquisition of the title to said property includ- ing the right to immediate possession thereof.
