1975-598RESOLUTION NO. 75R-598 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE FO. 2728. WHEREAS, after a request for variance by C. Micheal, Inc. was received,a public hearing before the Planning Commis- sion of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2728 was denied covering the following described property: All that certain land situated in the State of Cali- fornia, County of Orange, City of Anaheim, described as follows: The Westerly rectangular one-half of Lot 17 of Anaheim. Extension; as shown on a rap by William Hamel and filed December 11, 1868 in the office of the County Recorder of Los Angeles County, California. WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be granted permitting a 116 -unit, 117 -Lot RM -4000 subdivision on the property herein before described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.01.130 - Requirement that all lots abut a public street. (117 lots front- ipg on private streets) SECTION 18.31.065.011 - Minimum distance between buildings. (18 feet required; 10 feet proposed) That said variamce be granted subject to the following conditions: 1. That this variance is grante? subject to the completion of Reclassification No. 74-75-9. 2. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 3. r."hat s- ject property shall be developed substantially in accordance with rlans and specificatlions on. -'File with the City of Anaheim marked EXhibi-11-- 1Nos. 1 (Revision No. 2--) , 2, 3, 4, 5, 6 and 7. 4. That Condition -Nos. 'ell --nd 3, above-nment-3-tined, shall be complied with prior to final building and zoning inspecti-ons. 5. That no construction to add on or ex.,pand the d-vyelling units in Tract No. 8758 would be permitted amid this prohibition said included in the C.C. and R.'s for sa-t.trac4k--. BE IT F-UP_MEP RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheink -IM-3unicipal Code and rer,,-,ulations and the conditions herein.
