FACILITIES AND AUTHORIZING THE 2,2ffOR 27IND CITY
CLERK TO EXECUTE SAID ACR E1,1ENT.
WHEREAS, the Westfield Development Company, Inc., has
applied to the City of Anaheim for water facilities to serve Tract
8455; and
WIFIEREPAS, the City of Anaheira is unable to furnish water
to said Tract at an adequate pressure level to serve said Tract in
the absence of special facilities as defined pursuant to Rule No.
15 of the Water Rules of the City of Anaheim; and
SQL Ei�EAS, Westfield Development Company, Inc., is willing
to pay to the City of Anaheim its share of prior advances pursuant
to said Rule No. 15 and the City is willing to attempt to collect
from the ultimate users of said special f-acilitiesy and/or persons
within the Special Facility's District No. 1, the fees necessary to
reimburse Westfield towards the cost of said special facilities;
and
WHEREAS, an agreement has been prepared, the terms and
conditions of which are satisfactory to, and in the best- interests
of, the City of Anaheim.
NOVI, THEREFORE, BE IT FMSOLIVED by the City Council of
the City of Anaheim that the terms and conditions of an agreement
between the City of Anaheim and Westfield Development Company, Inc.,
in connection with reimbursement for special water facilities be,
and the same are hereby, approved.
BE IT FURTHER RE'SOL "VED that the .7�4ayor and City Clerk are
hereby authorized to execute said agreement on -behalf of the City
of Anahei-m.
