A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREE14ENT BETWEEN THE CORPORATION OF
THE PRESIDENT OF THE CHURCH OF JESUS CHRIST OF
LATTER-DAY SAINTS, MATREYEK HODS, INC., CITY
OF ANAHEIM AND THE ORANGE COUNTY FLOOD CONTROL
DISTRICT FOR THE SUBSTITUTION OF PRINCIPALS IN
LAND I1PROVEMENT PERMIT -AGREEMENT, AGREEMENT
NO. C-945, PERMIT NO. 18574, AND AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE SAME.
WHEREAS, Matreyek Homes, Inc., City of Anaheim and
Orange County Flood Control District have previously executed,
and are parties to, that certain Permit -Agreement, Agreement No.
C-945, Permit No. 18574; and
WHEREAS, Corporation of the President of the Church of
Jesus Christ of Latter -Day Saints (Corporation) is the owner of
Tract No. 8775 referred to in said Permit -Agreement, Matreyek
Homes, Inc. holding an unexercised option to acquire said Tract;
and
WHEREAS, Corporation has entered into a construction
contract with Silveri and Ruiz Construction Company to install
certain improvements on land owned by Corporation, including the
improvements referred to in the said Permit -Agreement; and
WHEREAS, it appears that the Corporation is the proper
party to'execute said Permit -Agreement as developer and not
Matreyek Homes, Inc.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agreement
between the Corporation of the President of the Church of Jesus
Christ of Latter -Day Saints, Matreyek Homes, Inc., City of Anaheim
and the Orange County Flood Control District for substitution of
principals in Permit -Agreement, Agreement No. C-945 and Permit No.
18574, be, and the same are hereby, approved.
BE IT . FURTHER RESOLVED that the Mayor aayd, City Clerk
be, and they are hereby, authorized and directed to execute said
agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
