A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
OF ANAHEIM AND THE COUNTY OF ORANGE RELATING
TO THE CHECKING OF FINAL TRACT AND PARCEL MAPS.
WHEREAS,, Section 66442 of the Government Code
(Subdivision Map Act) provides that if a subdivision for
which a final map is required lies within an unincorporated
area, a certificate by the county surveyor and., if such
subdivision lies within a city, a certificate by the city
engineer is required; and
WHEREAS, Section 66450 of theGovernment Code
provides that if a subdivision for which a parcel map is
required lies within unincorporated territory, the parcel
map shall be submitted to the county surveyor for his
examination prior to filing, and if such subdivision lies
within a city, the parcel map shall be submitted to the city
engineer for his examination prior to filing; and
WHEREAS, the County Surveyor of the County of
Orange presently checks the exterior boundaries of all City
of Anaheim final tract and parcel maps for accuracy; and
WHEREAS, the Office of the County Surveyor of the
County of Orange is the central repository for all recorded
surveys in the County; and
WHEREAS, the -City Council finds that it would be
for the benefit and in the best interests of the City to
retain the services of the Orange County Surveyor to provide
checking service for the exterior boundaries of all City of
Anaheim final tract and parcel maps; and
WHEREAS, the County of Orange has submitted to the
City a form of Agreement providing for the furnishing of
said map checking service for City of Anaheim final tract
and parcel maps and the collection of fees by the County for
said map checking service from owners and developers at no
cost to the City; and
WHEREAS, the City Council finds that it would be
in the best interests of the City to approve the proposed
Agreement between the City of Anaheim and the County of
Orange, and that the same should be approved.
NOW., THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said Agreement this day submitted
to the City Council to be made and entered into between the
City of Anaheim and the County of Orange providing for the
furnishing of checking service for the final tract and parcel
maps by the Orange County Surveyor upon the terms and
conditions as set forth in said Agreement be, and the same
is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute said
Agreement for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
