A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE ORANGE COUNTY FLOOD CONTROL
DISTRICT RELATING TO THE IMPROVEMENT OF
FULLERTON CREEK CHANNEL AND KIMBERLY STORM
CHANNEL.
WHEREAS, the City of Anaheim desires Kimberly
Storm Channel to be improved to preclude continued
flooding within the City of Anaheim; and
WHEREAS, Kimberly Storm Channel is tributary to
Fullerton Creek Channel and serves a highly industrialized
area which has experienced frequent flooding within the
City of Anaheim; and
WHEREAS, the Orange County Flood Control District
has appropriated funds for the improvement of Fullerton
Creek Channel from Lemon Street upstream to easterly of the
Atchison Topeka & Sante- Fe Railway along the northerly
boundary of the City of Anaheim; and
WHEREAS, the Orange County Flood Control District
has applied for and received approval of Federal grant
assistance for the construction of said channels from the
U.S.'Economic Development Administration; and
WHEREAS, it is mutually advantageous for the City
of Anaheim and the Orange County Flood Control District to
cooperate in the accomplishment and funding of said channel
construction Project; and
WHEREAS, the Orange County Flood Control District
has submitted to the City Council a form of Agreement for
construction of said channel as a joint Project; and
WHEREAS., the City Council finds that it would be
for the benefit and in the best interests of the City to .
approve the proposed Agreement between the City of Anaheim
and the Orange County Flood Control District.
NOW, THEREFORE, BE IT RESOLVED by. the City,Council
of the City of Anaheim that said Agreement this day submitted
to the City Council to be made and entered into between the
City of Anaheim and the Orange County Flood Control District
providing for the improvement of Fullerton Creek Channel and
Kimberly Storm Channel as a joint Project upon the terms and
conditions set forth in said Agreement be, and the same is
hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk be, and they are hereby, authorized to execute said
Agreement for and on behalf of the City of Anaheim.
