1976-247RESOLUTION NO. 7J 4y_ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in reclassification Pro- ceedings No. to consider an amendment to Title 18 of the -Anaheim :Pun_ic�6!�Vl_Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 11th day of May , 19 76_, and continued to the day of 19 , as the time, and the City Counc-l-r--C-Hanbers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim, municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED the City of Anaheim that Title IS of the be, and the same is hereby, amended and described property, situated in the City Orange, State of California, to wit: sa ATTY-18-C (Page 1 of 1 page) by the City Council of Anaheim Municipal Code that the following of Anaheim, County of 1 75-76-27 That portion of Lot 8 of Townsend's Subdivision in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 5, Page 40 of Miscellaneous Maps, in the office of the County Recorder of said County., lying southerly of Tract No. 6792 as recorded in Book 277, Pages 19 and 20 of said Miscellaneous Maps and lying northerly of Tract No. 4731 as recorded in Book 178, Pages 5 and 6 of said Miscellaneous Maps., and more particularly described as follows: Beginning at the southwest corner of said Tract No. 6792; thence along the southerly line of said Tract., North 890 121 43" East, 267-38 feet, to the southeast corner of Lot 15 in said Tract No. 6792; thence along the southerly prolongation of the easterly line of said Lot 15, South 001 55' 1011, East, 210.78 feet:toa.point on the . northerly line of previously mentioned Tract No. 4731; thence along said northerly line, South 890 12' 20" West, 267-34 feet to the northwest corner of said Tract No. 4731; thence North 001. 55, 481, West,, 210.81 feet to the point of beginning. Containing 1.294 Acres. be excluded from 'IRS -A-43,000". RESIDENTIAL/AGRICULTURAL ZONE, and incorporated in "RS -5000" RESIDENTIAL, SINGLE- FAMILY ZONE subject to the following conditions: 1. That the owner(s) of subject property shall deed to the City of Anaheim a strip of land 30 feet in width along each side of the projected centerline of Waverly Drive,, for a total width of 60 feet,.for street construction purposes. 2., That all engineering requirements of the City of Anaheim along Waverly Drive, including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks., streetgradingand paving, drainage facilities,, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; that street lighting facilities along Waverly Drive shall be installed as required by the Director of Public Utilities., and in accordance with standard plans and specifications on file in the Office of the Direcior of Public Utilities; or that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above- mentioned requirements. 1 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 4. That drainage of subject property shall be disposed of in a manner satisfactory to. the City Engineer. -2- 5. That the owner of subject property shall pay to the City of Anaheim the appropriate park and recreation in"lieu: fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 6. That a final tract map of subject property, indicating six (6) lots in conformance with all RS -7200 Zone site. development standards, shall be submitted to and approved by the City Council and then be recorded in the Office of the 'Orange County Recorder. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim. marked Exhibit No. 1; provided, however, that there shall be a maximum of six (6) lots, which shall be developed in accordance with the RS -7200 Zone site development standards as stipulated to by the petitioner. 8. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos 1, 2 and 6, above- mentioned, shall be completed. The 'provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 9. That Conditions Nos. 4 and 7, above- mentioned, shall be complied with prior to final building and zoning inspections. 10. That if any building is to be erected on the Southern California Edison Company (Sierra Electric Company) easement along the south boundary of subject property, petitioner stipulated to obtaining' a. letter from said company, approving such construction, prior to issuance of a building permit. BE IT FURTER RESOLVED that the City Attorney `be, and he is - hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Cade to accomplish the objects herein found and determined to be necessary and proper.
